Cuomo, It has come to my attention that the immigrants housed in the Orleans Correctional Facility are being treated sub-human. Because of the pain I experience every time I am faced with human suffering involving the New York State Department of Corrections, I have chosen to cut and paste part of an article I found on the internet rather than use my own words to describe my feeling regarding these issues. Migrants apprehended on or near the border encounter the U.S. Border Patrol, which has a reputation for using racist language, confiscating food, forcing people to abandon their backpacks and beating them with flashlights. Undocumented immigrants already living in the U.S. are arrested either by local law enforcement or by Immigration and Customs Enforcement (ICE) officers, often in raids. Upon arrest, both migrants and U.S. residents suffer the same kinds of abuse. Some detainees do not receive food or water for as long as 24 hours. Frequently, they are not allowed a phone call, do not have access to a lawyer and are told to sign paperwork they do not understand. They may be transferred quickly to detention centers or prisons in other states, where they are “disappeared” from family and friends. Prisons and detention centers everywhere are overcrowded, with people jammed into cells with little or no room to sit or lie down. Usually there is one dirty toilet, with a pipe next to the toilet the only water supply. Some take turns sleeping on cold concrete floors. Nearly all detainees report that they are held in very cold conditions and that requests for blankets are regularly denied. Meals, served twice a day, are sparse; sometimes the food is cold or frozen, and smells and tastes bad. Should the detainees try to save a little food for later, the guards take it away. Medical care is often denied. A young man, whose knee is painfully swollen after being kicked by a Border Patrol Officer, asks for but receives no treatment. A pregnant woman is beaten but is refused medical care. A diabetic does not get insulin. A woman suffering from lung cancer needs medication every four hours but does not get it. A man with epilepsy is refused medication, suffers a seizure and splits open his chin. Eventually, he is taken to a hospital, where he receives stitches. Two days later —still with no medication — he returns to the prison and has another seizure. This time he breaks his nose. Physical and verbal violence are prevalent. An old man who is shaking is thrown onto the floor. A diabetic in a wheelchair is slammed against a wall. Women are strip-searched and groped. One woman has a gun held to her throat. Men are stripped and forced to sit naked on the floor. Documented interviews reveal that guards laugh and mimic the mentally ill and the infirm. They call the detainees “Dirty Mexicans” and “Stinky Pigs” and use four-letter words to describe them. Lockdowns can occur for the slightest infraction; in one case, women were not allowed to talk or leave their beds for three days. These documented stories reveal a disturbing pattern of abuse regardless of whether the deportees 1) have been apprehended in the desert or in the U.S.; 2) are held for three days or three months; 3) are held in local jails, in one of the 350 ICE prisons, or in one of the 60 prisons run by Corrections Corp. of America (CCA). There are no nationwide standards for the treatment of undocumented immigrants. Both ICE and CCA prisons operate with minimal oversight and with impunity. CCA, a for-profit prison business, has a documented history of letting detainees die as a result of inadequate medical care. Take Hiu Lui Ng, 33, a computer engineer from New York who had overstayed his visa, and was interred in the CCA Wyatt Detention Center, in Central Falls, R.I. In agony from an undiagnosed fractured spine and advanced liver cancer, Ng was repeatedly denied medical care. He died in Rhode Island Hospital on Aug. 5, 2008. As a people with a reputation for compassion, we cannot let these abuses to continue. Law-enforcement agencies must be held accountable for abuses that immigrants suffer while in custody. Koenigsmann, Deputy Commissioner/Chief Medical Officer, for the Assault, Guard Brutality, Starvation, Conspiracy, Medical Malpractice, Medical Negligence and the attempted Murder of Angel Reyes Dear Honorable Andrew M. Cuomo, It appears that retaliation is axiomatic after contacting your office lately, if it walks like a duck and quacks like a duck, guess what, it’s a duck. A racist in any other name is still a racist. On 8/11/11 I received correspondence from Carl J. Koeningmann M.D. Deputy Commissioner/Chief Medical Officer from Department of Corrections and Community Supervision stating please be advised that Mr. Reyes is receiving necessary health care and services according to the policies established by the New York State Department of Corrections and Community Supervision, Division of Health Services… Clearly these services are inadequate, and or this was a blatant lie and he is now liable for Angel’s most recent medical conditions and the State is liable for Angel’s most recent sequence of events. Angel Reyes has provided me with written authorization to retain his medical records and to move on anything pertaining to him including death reports and to file a civil action in the event that he expires due to homicide or medical induced related conditions. The Department of Corrections has been unsuccessful in murdering Angel Reyes thus far through the gangs, therefore are now using malnutrition to have him die of a sugar diabetic coma or seizure. According to witnesses this is no coincidence and either those animals have learned to read or have been provided with Angel’s confidential medical information breaching his Federal Health Insurance Portability and Accountability Act (HIPPA) rights. Surely, Carl J. Koeningmann M.D. Deputy Commissioner/Chief Medical Officer from Department of Corrections and Community Supervision knew there was an issue with Angel’s sugar the first time he passed out weeks ago, and surely Carl J. Koeningmann M.D. Deputy Commissioner/Chief Medical Officer from Department of Corrections and Community Supervision knew that the loaf diet was medically unsound and surely this is not the first time this has happened to a NYS Prisoner or that Carl J. Koeningmann M.D. Deputy Commissioner/Chief Medical Officer from Department of Corrections and Community Supervision has blown off a serious issue . Surely, Carl J. Koeningmann M.D. Deputy Commissioner/Chief Medical Officer from Department of Corrections and Community Supervision is aware that starvation will lead to this and other medical conditions. It’s obvious to even a fool that starving a healthy man or a man predisposed to sugar diabetic conditions will induce a negative reaction including sugar diabetic coma and or seizure. It is needless to say, that based on Angel’s current condition and treatment thus far, stemming from the first incident weeks ago when he passed out in the yard causing injury to his face when he was denied adequate medical treatment and proper diagnosis at that time, that should he slip into a diabetic coma he will be denied life saving medical treatment increasing his chances of death, and the State will transfer his body to another prison like Pierre Smith with a new set of incomplete medical records. I suggest you investigate and find the gang member who put a hit on Angel’s life and which officer(s) have been paid to execute Angel like Pierre Smith. Angel has already gone into SHU for protection yet, clearly you can see the determination of the State to kill him. On 8/13/11Angel Reyes was placed on a loaf diet, on 8/18/11 he was taken to the infirmary and on 8/19/11 he passed out in the infirmary but instead of him being provided with medical treatment he was savagely beaten by NYS Corrections Officers and left to die. According to witnesses the infirmary is where prisoners are taken to be beaten because there are no cameras. On 8/20/11 Angel's blood sugar level was 42 and he was entering a stage for having a seizure, the nurses recommendation was to provide him with a supplemental ensure drink to boost his blood sugar level to a safe level, but the officers insisted that he be denied this life saving 8 ounce drink. Angel has lost a great deal of weight as well and clearly this is a sign of mal-nutrition and stress a deadly combination. Please inform the good ole boys that they have walked us step by step through the death of Pierre Smith and countless others. Based on the reasons set forth I demand an answer from your office explaining why the Department of Corrections and its Administrative and over sight agencies are allowed to falsify death reports and the medical records of NYS Prisoners. Further it is imperative that criminal assault charges be filed against the officers who attacked Angel and that Angel be transferred closer to home for the remainder of his bid, because clearly his life is danger from the gangs and the staff i.e. the State and especially Carl J. Koeningmann M.D. Deputy Commissioner/Chief Medical Officer from Department of Corrections and Community Supervision. Further as the President/Founder and Chief Commissioner of Civil Rights from MAIN I find that Carl J. Koeningmann M.D. Deputy Commissioner/Chief Medical Officer from Department of Corrections and Community Supervision has violated Federal Fraud and Abuse Statues. Federal Civil Monetary Penalties (Section 1128A of the Social Security Act/42 USC 1320a-7aa). Health care professionals and entities are prohibited from presenting or causing to be presented claims for services that the individual or entity "knows or should know" were not provided as claimed. Civil monetary penalties (CMPs) may be applied in situations where the service was not provided as claimed or where the service was provided during a period in which the professional or entity was excluded from the program. Violation may result CMPs of up to $10,000 per claim, or $15,000 for each individual with respect to whom false or misleading information was given, and assessment payments (with part going for restitution) of up to three times the amount claimed. The Health Insurance Portability and Accountability Act of 1996, Public Law 104-191 (HIPAA), clarified that the term "should know" includes, with respect to information set out in a claim, "acts in deliberate ignorance" or in "reckless disregard of the truth or falsity" and "no proof of specific intent to defraud is required." Federal Civil False Claims Act (31 USC 3829-3733). The Act imposes liability upon anyone who knowingly makes, uses, or causes to be made or used, a false record or statement to get a false or fraudulent claim paid or approved by the Government. Depending on the applicable part of the statute, a false statement may or may not be necessary on the claim submitted to the Government for payment for liability. Fraud and Abuse Control Program (Section 1128C of the Social Security Act/42 USC 1320a-7c). Authorized HHS, acting through the HHS Office of the Inspector General (OIG), and the Department of Justice (DOJ) to design, implement and coordinate the federal Fraud and Abuse Control Program. The purpose of the program is to: coordinate Federal, State, and local law enforcement programs to control fraud and abuse in health plans; conduct investigations, audits, evaluations, and inspections relating to the delivery of and payment for health care; facilitate the enforcement of health care fraud and abuse laws; issue advisory opinions and special fraud alerts; and provide for the reporting and disclosure of "final adverse actions" against health care professionals, providers, or suppliers. HHS and DOJ are to issue guidelines concerning the provision of information to carry out the program from health plans, health care professionals and entities. Obstruction of Criminal Investigations of Health Care Offenses (18 USC 1518). Anyone who willfully prevents, obstructs, misleads, or delays or attempts to prevent the communication of information or records relating to a violation of a federal health care offense to a criminal investigator may face fines and up to five years imprisonment. False Statements Relating to Health Care Matters (18 USC 1035). Anyone who knowingly and willfully falsifies or conceals a material fact or makes a materially false fictitious or fraudulent statement in connection with the delivery of or payment for health care benefits, items or services may face fines and up to five years imprisonment. Why, oh why in the name of God are you doing this to us, why. If the Prisoners Legal Services of NY provides Legal Services to NYS Prisoners then why are NYS Prisoners being vehemently denied the services? If there is an administrative remedy then why are NYS Prisoners being denied these remedies? If there is a duty owed to the NYS Prison population of care, custody and control then why are they being denied? These matters warrant an investigation into all agencies associated with the NYS Department of Corrections who appear to desperately be in need of reform far more than the prisoners themselves.     Hi Regina Lewis, I am The Aunt of Inmate Miguel Rodriguez DIN # 08A-6223 Housed at clinton Corr.Fac. In Dannemora, N.Y. 12929.. I have recieved your correspondence and my nephew's reports of constant abiuse and severe beatings from 8 Correctional Officers.. I am appauled by this conduct as well as disgusted of how cruel these C.O.'s are to thier inmates. my nephew was badly beaten as you know and starved for 24 hours and had no medical treatment and has been threatened of death and also of being framed by the C.O's to be given more time in prision when his release date is on October 27th 2011. I respect your work very much. I am afraid for my nephew's life!!! Please contact me as soon as you recieve this ..I need to know what more I should be doing besides sending copies of the letter youv'e sent me to the corresponding addresses..I am trying to contact a Lawyer in Dannemora for further assistance with his case and I'd like to keep him alive or transferred from Clinton Corr.
