Paying an Inmate's Bail or Bond in Madison County

The Madison County Sheriff recommends that you use a bail bond agent licensed to do business in Madison County.

  • You can pay a cash bond yourself, or use your home in Madison County, or in some cases the state of Indiana, but the benefit of using a bail bond agent is that they take responsibility for making sure the inmate shows up for court in Madison County, and if they don't, then they take the financial responsibility.

Bail Bond Restrictions

  • If defendant’s residence (or usual place of abode) is within the State of Indiana, but outside Madison County or its contiguous Counties, the normal bond shall be doubled.
  • If defendant’s residence (or usual place of abode) is outside the State of Indiana, the normal bond shall be tripled.
  • If defendant, at the time of arrest, is on parole or probation, or is free on bail awaiting trial on other charges, he shall not be admitted to bail per this schedule, but shall be brought before a judge or magistrate of Madison County on the next regular day of Court who shall set bail or order other disposition. (The presiding Judge, if available, of the Division in which charges have been filed shall determine bail.)
  • A detainee-defendant arrested for the commission of any of the following crimes shall not be afforded access to the felony bond schedule and shall be held pending an initial hearing by a judicial officer, which shall occur on the next regular day of Court:
  1. Aggravated Battery
  2. Arson (endangering human life or causing bodily injury)
  3. Battery (any type not resulting in death)
  4. Burglary
  5. Car Jacking
  6. Child Exploitation
  7. Child Molesting
  8. Child Seduction
  9. Criminal Confinement
  10. Criminal Deviate Conduct
  11. Criminal Recklessness
  12. Escape From Lawful Detention (drawing or using a deadly weapon or inflicting bodily injury on another person)
  13. Exploitation of an Endangered Adult (at least 60 years of age)
  14. Failure to Return to Lawful Detention (drawing or using a deadly weapon or inflicting bodily injury on another person)
  15. Harassment
  16. Hazing (resulting in bodily injury to another person by means of a deadly weapon)
  17. Human Trafficking
  18. Inappropriate Communication with a Child
  19. Invasion of Privacy
  20. Incest (with a minor)
  21. Intimidation
  22. Kidnapping
  23. Malicious Mischief
  24. Neglect of a Dependent (resulting in bodily injury)
  25. Performing Sexual Conduct (in the presence of a minor)
  26. Provocation
  27. Rape
  28. Residential Entry
  29. Robbery
  30. Sex Offender (internet offense)
  31. Sexual Battery
  32. Sexual Misconduct with a Minor
  33. Stalking
  34. Strangulation
  35. Terrorism (resulting in bodily injury to another person)
  36. Timber Spiking (causing bodily injury to another person)
  37. Vicarious Sexual Gratification
  38. Violation of a Protective Order

Only a surety bond is available to Defendants in the following circumstances (no exceptions):

  • If charged with an A, B, Level 1 or Level 2 felony.
  • If residence (or usual place of abode) is outside Madison or its contiguous counties.

Option 1 - How to Post Bail using Cash for a Defendant at Madison County Detention Center

The first option, a cash bond, is to pay the full bail amount in cash, cashier's check, or money order. Personal Checks are not accepted.

Depending on the crime, this amount could be anywhere from $100 to $75,000 or more.

To pay a cash bond, go to Madison County Detention Center or to the court where the bail hearing occurred. Going directly to the jail will quicken the release of the defendant as any bail paperwork processed at the court will have to be transferred to the jail.

Cashier's Checks and Money Orders may be made out to Madison County Detention Center where the defendant is being held, but usually to the Madison County Sheriff's Office or to the Madison County Court.

Option 2 - How to Post a Private or Surety Bond for a Defendant at Madison County Detention Center

In the event that someone does not have the full bond amount available to him or her, there is what is called a private bond or surety bond.

This is an agreement made with a bail agent or bondsman who will post the full bail amount. In return, the defendant and/or cosigner will pay a premium to the bail agent. This premium will be 10-15% of the full bail amount.



For example, if bail is posted at $5,000, then the premium will cost approximately $500-$750.

A bail agent will often require some form of collateral, for example, a lien on a house, a car or jewelry. This is to ensure that if the defendant skips bail, or does not appear in court, the bail agent has some sort of compensation for the full bail amount being paid.

Remember, by making an agreement with a bail agent the signatory takes responsibility for paying the full bail amount if the defendant does not appear in court.

Option 3 - How to Post a Property Bond for a Defendant at Madison County Detention Center

If you are a landowner in Madison County you may be able to post a property bond. Property within Madison County may be used as collateral to bail someone out. All owners of the property must be present to sign the bond in order for this to happen.

When will the Cash Bail or Collateral be returned to me?

Money or collateral will not be returned until the defendant's court case is finished, so realistically it could take several months to years, depending on the severity of the charges. If a defendant posts his or her own bail, Madison County Court may retain whatever amount of fines or fees have accumulated throughout the trial.

What happens to my Bail or Collateral if the Defendant misses Court?

The Madison County Judge may order a failure to appear warrant for the person's arrest or the Judge may order a Bail Commissioner's Letter be issued that will be sent to the person with a new court date.

If cash bail was paid, the entire amount may be forfeited.
