If ICE has an interest in your boyfriend, it notifies the jail to place a detainer on him. A detainer means the jail will hold him for up to 48 hours. If ICE does not interview him within that time, the detainer expires. What this means to you is if there is an ICE detainer on your boyfriend, even if you pay the bail, he cannot be released. However, if ICE does not take action within the required timeframe and you have paid a bond, the jail must release him. In addition, if your boyfriend has prior criminal convictions, ICE can get him held without any bond.
