How do federal charges work after a Boulder County arrest?

A federal arrest that starts in Boulder County does not go through the local court system. The hearings take place inside the Alfred A. Arraj U.S. Courthouse in Denver, 901 19th Street, Denver, CO 80294; the court clerk answers at 303-844-3433. Shortly after being arrested, your relative faces a U.S. magistrate judge for a first hearing.

There is no fixed bail table. So the judge holds a custody hearing to choose whether your relative walks out until trial and under which conditions. Before trial, many federal defendants sit in a jail close by under a deal with the Marshals Service. For their location, contact the U.S. Marshals on 303-728-7800. Once prison time comes down, the federal Bureau of Prisons (BOP) takes charge, and the BOP inmate locator gives you the place.

What if ICE asks Boulder County to hold someone?

First: At booking, prints are checked in federal databases that ICE can see.

Next: If ICE wants the detained person, the agency files a detainer with Form I-247A with jail staff.

Then: The form asks to keep the arrested person up to 48 additional hours beyond the scheduled release. Those hours run without a break, including holidays and weekends.

But: Colorado's statute, C.R.S. 24-76.6-102, states plainly that a jail can't keep a person longer solely on ICE's request. So Boulder County sets the defendant free on time unless some other legal hold applies.

Finally: Officers from ICE can come when your family member is let out to take custody. When they do not show up, your relative goes free.

To check ICE custody, use the online locator — search by registration number or name and date of birth and the birth country.

The Aurora contract detention center lists 3130 North Oakland Street, Aurora, CO 80010 and 303-361-6612 as its contact line.
