4. Bail in short: key facts

  • Bond terms after a Walden arrest come from a judge.
  • Deadline: Colorado gives judges up to 48 hours from jail arrival to review bond in most cases.
  • Personal recognizance: release on a written promise to return to court.
  • Posting cash: pay every dollar in cash or an accepted form; it may be returned later.
  • Agent fees top out at 15% of the bond with a $50 floor.
  • Using land: property in Colorado may back the bond when the paid-off share is 150 percent of that amount.
  • Conditions: the court may order supervision or no contact with any victim or a curfew.
  • Still held? Another case may delay release after bond is posted.
  • Failing to appear: a missed hearing may mean a warrant and the loss of bond money.

13. How does a federal case work?

Any federal charge from Jackson County doesn't remain in the state court system. Hearings take place inside the Alfred A. Arraj U.S. Courthouse in Denver, 901 19th Street, Denver, CO 80294, and its clerk answers at 303-844-3433. Within a day or so after being arrested, the defendant stands before a U.S. magistrate judge for an initial appearance.

Federal court has no bail schedule. Instead, the judge sets a custody hearing to learn if your family member is released pending trial and with what rules. Meanwhile, a lot of federal defendants are housed in a local jail under a deal with the Marshals Service. To ask which jail they are in, ring the Marshals at 303-728-7800. Once a federal prison term is set, the Bureau of Prisons (BOP) gains custody, and the BOP inmate locator displays the location.

14. What does an ICE detainer do?

Step one: When someone is booked, the fingerprints are sent to federal systems that ICE can search.

Step two: If ICE decides to act, the agency sends a hold request using Form I-247A.

Step three: That detainer asks the jail to hold the one held 48 added hours at most past the regular release time. The clock runs nonstop, including holidays and weekends.

Step four: State law, C.R.S. 24-76.6-102, makes clear county jails may not keep anyone beyond release only because ICE asked. That means Jackson County lets the inmate out on schedule unless another legal reason exists.

Step five: Officers from ICE can come as the arrested person you know leaves to take custody. Otherwise, your relative is released.

Find someone ICE holds through the ICE locator. Enter an alien registration number with their home country.

The Aurora contract detention center lists 3130 North Oakland Street, Aurora, CO 80010 and 303-361-6612 for questions.

15. Going from jail to state prison

Once a prison term is ordered, the arrested person remains at the Walden county jail until CDOC moves them. At reception, CDOC screens each new prisoner on security risk, medical needs and other needs before classifying them.

From there, CDOC assigns your loved one to a prison that fits their needs. Try Colorado's offender search with a name or DOC number; the prison directory lists each prison's address.

16. Are Jackson County mugshots posted online?

Jackson mugshots show online only if Jackson posts a roster. VINELink for Jackson covers custody status but not pictures. Reporters seeking a mugshot not shown publicly might check with the Jackson County sheriff's office at 970-723-4242.

A mugshot from ICE must be requested at the ICE records request form; then ICE has to approve the request.

Federal booking photos are kept from ordinary individuals and the media. One exception applies: the U.S. Marshals Service, the agency that takes federal mugshots, can put out an image about a wanted fugitive when that helps bring them in or alert people, and also for a present danger to the public.
