Court dates take place at Grand Junction's Wayne Aspinall Federal Building, 400 Rood Avenue, Suite 309, Grand Junction, CO 81501; its clerk answers at 970-245-5396. Not long after booking, the person stands before a U.S. magistrate judge for a first appearance.
There's no bail schedule in federal court. In place of that, the magistrate judge schedules a detention hearing to figure out if your relative can leave before trial and with which conditions. Meanwhile, most federal prisoners are held in a local county jail under a deal with the U.S. Marshals. To find out their location, ring the Marshals on 970-243-5210. After a judge orders prison, the federal BOP system takes charge. From then on, the BOP inmate locator lists where they're held.
Back to questions ↑How does an ICE detainer work in Montrose County?
Step 1: As part of booking, fingerprints are checked in national databases ICE has access to.
Step 2: If ICE is interested, the agency issues an immigration detainer by way of Form I-247A.
Step 3: The I-247A seeks up to 48 extra hours past when the defendant would be released. That time counts nonstop, weekends and holidays included.
Step 4: Colorado's statute, C.R.S. 24-76.6-102, spells out that a jail cannot keep someone longer only because ICE asked. So Montrose County has to let them go at the usual time except if a court order applies.
Step 5: ICE agents may come at release time and take custody. Otherwise, the one held goes free.
The fastest way to find someone is the online ICE detainee locator, searched by registration number or name and birth date and the birth country.
