How do I post bond in Park County?

  • The bond for an arrest in Fairplay is set by a judge.
  • Deadline: state law gives courts roughly 48 hours after jail arrival to set bail.
  • Personal recognizance: sometimes a judge lets the inmate go with only a signature to return at the Fairplay courthouse.
  • Full cash bond: someone pays the whole amount.
  • Licensed agents cover the bond for you and keep their fee. Colorado's cap is 15% or $50, whichever is more.
  • Property in Colorado counts only when the equity in it is worth 150 percent of the bond.
  • Bond conditions: getting out may come with check-ins, orders to stay away from someone, and more.
  • Still held? Another case can delay the release after bond is posted.
  • No-shows: a skipped hearing date can mean a warrant, plus the loss of the bond.
  • First call: phone the Fairplay jail at 719-836-4373 for the current bond amount.

Where do federal cases from Park County go?

A federal charge from Park County is taken out of the local court system. Hearings take place at the Alfred A. Arraj U.S. Courthouse in Denver, 901 19th Street, Denver, CO 80294, and the court clerk answers at 303-844-3433. Right after booking, the detained person goes before a U.S. magistrate judge for a first hearing.

No price list for bail exists in federal cases. So the magistrate judge runs a short detention hearing that settles if the charged person is released while the case is open and what rules apply. In the meantime, lots of federal detainees sit in a jail close by under an agreement with the U.S. Marshals. To learn where someone is held, phone the Marshals at 303-728-7800. If prison time is ordered, the BOP, which runs federal prisons, takes charge; the BOP inmate locator names the prison.

How does an ICE detainer work in Park County?

First: At booking, fingerprint scans go to federal systems shared with ICE.

Next: Once ICE shows interest, the federal agency files a detainer using Form I-247A with the Park jail.

Then: The detainer asks for as many as 48 additional hours following the planned release. Those hours run nonstop; weekends and holidays aren't skipped.

But: State law in Colorado, C.R.S. 24-76.6-102, states county jails can't keep anyone longer solely because ICE asked. So Park County lets them walk out on schedule except when some other legal hold says otherwise.

Finally: Officers from ICE may show up at release time and pick the person up. Otherwise, the detained person walks out.

Family can find the person on the ICE detainee locator. Search by A-number; you can also search by full name and birth country.

Many people held by ICE in Colorado stay at the Aurora center. Address: 3130 North Oakland Street, Aurora, CO 80010; phone 303-361-6612.

ICE's Denver field office sits at 12445 East Caley Avenue, Centennial, CO 80111. Call 720-873-2899.

After classification, that person is assigned to a prison suited to that level. Use the Colorado DOC locator. Our Colorado state prisons page lists addresses.
