Idaho County bail and bond: the Grangeville jail and the courthouse next door

People arrested in Idaho County are booked into the Idaho County Jail at 320 West Main Street in Grangeville, run by the Sheriff's Office.

Start with Idaho County Inmate Search to see if your person is in custody, what the charges are, and what the bail is. The jail desk is 208-983-1123 for anything the search cannot answer.

Money for a bond is paid at the District Court office in the same building, not at the jail.

Search for an Inmate or Active Arrest Warrant in Idaho County

1. Is my family member in the Grangeville jail?

Look the name up on Idaho County Inmate Search. It lists who is in custody and the booking details. A person arrested only minutes ago may not appear yet, so check again later. If the name still is not there, call the jail at 208-983-1123 and ask if the person was sent somewhere else.

The jail is small. The jail is small, so crowding can move people to other jails.

2. What do I do first after a loved one is picked up in Idaho County?

Write down the full legal name, birth date, and what you know about the arrest. Run the name through Idaho County Inmate Search. Then decide who will handle money, because a bail payment is a separate trip from a jail visit.

Do not send money to the jail for release. Release comes from posting bail with the court. The sheriff's main office can answer general questions at 208-983-1100.

3. Where do I pay a bond, and can I use a credit card?

The Sheriff's Office says bonds are paid during business hours at the District Court office, either in person or by phone, with a credit card.

The District Court clerk is in Room 23 of the courthouse at 320 West Main Street. Call 208-983-2776 to ask about other payment forms before you go.

↑ Back to the question list

4. When is the court office open for bond payments?

The county lists the clerk of the District Court as open Monday through Friday, 8:30 a.m. to 5:00 p.m., Pacific time. The courthouse hours are the same.

A person booked on a weeknight evening or on a weekend may have to wait for the office to open. Ask the jail desk at 208-983-1123 what can be done sooner.

5. How much is bail for a misdemeanor?

Idaho has one statewide misdemeanor bail bond schedule, adopted under Idaho Misdemeanor Criminal Rule 13 and effective January 4, 2023. A first DUI costs $500 for an Idaho resident and $2,000 for a nonresident, and an enhanced-penalty DUI costs $1,000 and $3,000 in the same order. Resisting or obstructing an officer carries a $300 bond.

Driving without privileges and disturbing the peace are listed as "Book & Release," which means the person is booked and then let go. A domestic assault or battery that is a first or second offense, or breaking a no-contact order, has no bond until an Idaho County judge hears it. A magistrate can change any listed amount.

↑ Back to the question list

6. What is bail for a felony?

The misdemeanor rule does not cover felonies. A magistrate sets bail for a felony at the first court appearance, and the judge looks at the charge, the person's record, and safety. The amount can be very different from one case to the next.

Call the District Court clerk at 208-983-2776 with the case number and ask what the judge set.

↑ Back to the question list

7. Who decides the amount, and how fast?

Idaho Criminal Rule 5 says an arrested person must be taken before a magistrate promptly. The delay may not be more than 24 hours after the arrest, leaving weekends and holidays out. At that appearance, the magistrate sets bail.

If the arrest was on a warrant, the amount written on the warrant normally stays unless an Idaho County judge finds good cause otherwise.

↑ Back to the question list

8. Must I pay the whole Idaho County bail in cash?

No. Idaho Code 19-2907 says bail can be posted with a cash deposit, an Idaho County bail bond, or real property, and a defendant cannot be forced to pay cash. Under Rule 13, a cashier's check or a money order in the name of the clerk can also work, and a personal check needs the judge's approval.

The Idaho Bail Act has no ten percent deposit option. If someone offers one, ask the clerk at 208-983-2776 whether the court allows it.

↑ Back to the question list

9. What does a bail agent charge?

An Idaho County bail agent posts a surety bond for a fee. The Idaho Bail Act does not set a fee cap, so the price comes from the contract. Ask for the fee, any extra collateral, and the missed-court terms in writing before you sign.

The agent must be licensed by the Idaho Department of Insurance. The jail and the court cannot recommend one company over another.

↑ Back to the question list

10. Can a house or land be used as a bond?

Yes, if the judge accepts it. Idaho Code 19-2909 says real property must be Idaho property, and its Idaho County equity, after liens, must at least equal the bail plus expected collection costs. The poster pays all recording fees, and the bond becomes a lien on the property.

Rule 13 lets only a magistrate approve and accept a property bond. Call the clerk at 208-983-2776 to ask how to start.

↑ Back to the question list

11. Why does it say no bail for my relative?

The Idaho Bail Act, section 19-2903, gives a right to bail before trial except for a capital offense where the proof is clear or the presumption is great. A first or second domestic assault or battery has no bond until a court appearance under the statewide schedule.

A hold from another county, a probation violation, or a warrant from another place can also keep a person in. For the reason in a case, ask the clerk at 208-983-2776.

↑ Back to the question list

12. Who is the free lawyer if we cannot pay?

Idaho County does not run a public defender office. The State Public Defender lists the county as served by contracted public defenders. Ask the judge for a court-appointed defense lawyer at the first appearance.

To learn which lawyer holds the contract, call the District Court clerk at 208-983-2776. A lawyer can ask the judge to lower bail.

↑ Back to the question list

13. What if the person picked up is a teenager?

Call Juvenile Probation at 208-983-0339. The office is in Room 28 of the courthouse and the chief juvenile probation officer is Nadine McDonald. A juvenile record is private, so Idaho County Inmate Search will not show a child.

The state lists the Nez Perce Juvenile Detention Center in Lewiston, at 140 10th Street, 208-799-3153, as the closest detention center. Ask probation whether a young person from Idaho County would be held there.

↑ Back to the question list

14. What if the Idaho County arrest happened on tribal land?

Parts of Idaho County are on the Nez Perce Reservation. A tribal agency may be the one that made the arrest, and then the case may belong to a different court. Ask the arresting officer which agency it was.

If the arrest was by the Sheriff's Office, the case starts in Idaho County court. The jail desk at 208-983-1123 can tell you which agency booked the person.

↑ Back to the question list

15. What happens if my person misses a court date?

Idaho Code 19-2915 says the court must order the bail forfeited, with a Grangeville bench warrant to follow. The clerk mails notice to the Idaho County person who posted. If the warrant is quashed within 180 days, the forfeiture is set aside.

Call a lawyer and the clerk at 208-983-2776 the same day. Do not wait until the warrant is served.

16. When do I get my bail money back?

A cash deposit left at the end of the case is first applied to fines, fees, costs, and restitution in the defendant's criminal cases, under Idaho Code 19-2908. Any surplus goes back to the Idaho County poster it.

A bail agent's fee stays with the agent. Keep every receipt with the case number.

17. Who might try to cheat my family?

No court takes gift cards, crypto, or a wire to a private person. Call the numbers on this page yourself: the jail at 208-983-1123 and the clerk at 208-983-2776.

A caller who rushes you or asks you to keep it secret from the family is not the court.

18. What if my person is at the prison in Cottonwood?

The North Idaho Correctional Institution, 236 Radar Road in Cottonwood, 208-962-3276, is a state prison run by the Idaho Department of Correction, not the county jail. Its residents serve sentences or retained jurisdiction, so bail does not apply. Look the person up on the Idaho Department of Correction resident search.

19. Does Idaho County bail cover a federal charge?

Federal rules replace Grangeville bail. A federal warrant served in Idaho County falls outside the schedule Grangeville uses for Idaho bail, and Idaho deputies cannot set an amount for it. Idaho County federal cases go to the U.S. District Court for the District of Idaho, Central Division, 220 E. 5th St., Moscow; so for a Idaho case call the clerk at 208-882-7612.

  • A U.S. magistrate judge calls the Idaho County case first after agents bring your loved one from Idaho County, usually within a day or two.
  • No money chart applies to Idaho federal cases. Using 18 U.S.C. 3142, the judge can release the Idaho defendant on conditions or order detention.
  • When detention is requested in a Grangeville case, the hearing for the Idaho County defendant follows quickly, unless a Idaho party asks to delay it.
  • Pretrial custody belongs to the U.S. Marshals Service, so a Idaho prisoner may be housed in a county jail that rents beds; phone 208-983-1123 and ask the Idaho County desk if your family member is there.
  • When the Grangeville federal case ends in prison time, the Federal Bureau of Prisons assigns a prison, shown on the Federal Bureau of Prisons inmate locator.

20. Can bail be posted in Idaho County if ICE places a hold?

Posting bail in Grangeville is allowed, yet Grangeville release may be slowed at Idaho County Jail. This is how it plays out in Idaho County:

  1. At intake in Grangeville, Idaho Code 18-9008 tells the jail to determine if the Idaho County arrestee is a noncitizen and, if the Idaho County check says so, alert the Department of Homeland Security within 48 hours.
  2. ICE may send a Form I-247A detainer naming the Idaho prisoner.
  3. The Grangeville jail must follow a reasonable detainer under Idaho Code 18-9005(4) after the Idaho case no longer holds them, and the Grangeville jail must say why the arrested person is held.
  4. Once bail on the Idaho County charge is paid, ICE gets a Idaho County window of up to 48 hours, including weekends and holidays.
  5. Officers from the ICE Boise office, 1185 S. Vinnell Way, Boise, ID 83709, 208-685-6635, take custody at the Idaho jail; ICE frequently moves Idaho detainees to the Elmore County Detention Center in Mountain Home and then a Idaho detainee may go out of state.
  6. Look up the ICE Online Detainee Locator System by Idaho A-number, or by the Grangeville detainee's name and native country.

Get legal advice before posting in Grangeville, because the bond only covers the Idaho County charge.
