About the Butte-Silver Bow Detention Center

With a top capacity of 72 inmates, both felony and misdemeanor offenders, the brick building that contains the Butte-Silver Bow Detention Center that serves both Silver Bow County and Butte County, houses all male and female inmates.

The jail is nestled into the city and created with brick to blend into the neighborhood, with the detention center operating all day every day.

To determine if someone is being held at the location an online roster is maintained, and staff are able to answer questions and take concerns by calling 406-497-1040.

An assessment is completed upon booking, and this will determine the housing assignment and security level of the inmate, along with addressing any immediate medical or mental health issues that need treatment, a treatment plan is created for ongoing rehabilitation and programs that will provide tools for reentry to society. The assessments include criminal history and background, their behavior in prior incarceration periods and the current one, disabilities, and personal history.

After this process offenders are able to make phone calls to family, friend, or to their lawyer or employer to report their location and arrange for legal representation as needed.

Programs are offered throughout the length of detention and include AA and NA, therapy and counseling, substance abuse treatments, and behavioral therapies. Full medical care is provided, along with mental health care, and a nurse, doctor, emergency dental care, therapist, and others are available to provide this care around the clock.

Bond may be paid at the jail directly, either with cash or through use of a bail bondsman.

What happens during booking in Silver Bow County?

After being arrested and taken into custody, and after being read their Miranda Rights, an offender will next be transported to the local police or department or the Sheriff’s Department in Silver Bow County for booking.

Booking is very involved and requires multiple steps in the process, however, keep in mind that most attorneys will advise that an offender remain silent and not offer any additional information about the crime they have been arrested for because anything they do say may be recorded and may very well be used against them in court.


 

 

What is the booking process like at the Butte-Silver Bow Detention Center?

During the arrest and booking process an offender will also have all their personal property confiscated and held for either their release from jail, or with the offender’s approval, released to a friend or family member.

Personal property includes the clothing they are wearing, money, wallets, purses, cell phones, jewelry, body rings, earrings, watches, and even glasses if they are deemed a security risk. If they are allowed to keep their shoes or sneakers, the laces are removed.

If the offender remains in jail for any length of time, the Butte-Silver Bow Detention Center will allow a friend or family member to pick up the inmate's property if the offender gives written authorization for a named person to do so.

How long does the Butte-Silver Bow Detention Center booking process take?

Booking can take anywhere from an hour to 24 hours or more. It all depends on the number of people that are awaiting processing, the number of staff on duty at the time, and the behavior of the offender.

If the offender is heavily intoxicated and/or violent, the Booking Officer may decide to stick the offender in a holding cell for several hours until they become more manageable.

Silver Bow County permits five types of bonds:

•    By a deposit with the court of an amount equal to the required bail of cash, stocks, bonds, certificates of deposit, or other personal property approved by the court.

•    By pledging real estate situated within the state with an unencumbered equity, not exempt, owned by the defendant or sureties at a value double the amount of the required bail.

•    By posting a written undertaking executed by the defendant and by two sufficient sureties.

•    By posting a commercial surety bond executed by the defendant and by a qualified agent for and on behalf of the surety company.

•    By posting an offender's driver's license in lieu of bail if the summons describes a violation of any offense as provided in 61-5-214 and if the offender is the holder of an unexpired driver's license.”
