Licensed for 52 inmates, the Choctaw County Jail often has to make room for many more offenders, especially on weekends. A typical city or county jail turns over at least 40% of its population every month, another 30% every 90 days, and another 20% every six months, with approximately 8-9% staying between six and twelve months. Inmates who stay longer than a year are usually facing serious charges like rape or murder. Because it takes longer to prepare those cases for trial, offenders arrested in Choctaw County remain in custody at the Choctaw County facility much longer.

The Choctaw County Jail at 217 South Hamburg Avenue in Butler closed for good on July 17, 2019, and the county has no working jail right now. A new jail is being built in Butler and should be ready in spring 2027. Until then, people arrested in Choctaw County are usually held at the Washington County Jail in Chatom, run by the Washington County Sheriff's Office, 45 Court Street, Chatom, AL 36518, phone (251) 847-2202. Placement can change, so always call the Choctaw County Sheriff's Office at (205) 459-2166 to confirm where someone is held before you visit, send mail or pay a bond.
The Choctaw County Sheriff's Office, led by Sheriff Scott Lolley, is in the Choctaw County Courthouse, 117 South Mulberry Avenue, Suite 11, Butler, AL 36904, and answers at (205) 459-2166. It handles arrests, warrants and bond questions for the county. Visits, mail, phone calls and deposits follow the rules of the jail that is holding the person, not the old Butler jail, so ask that jail before sending anything to the Hamburg Avenue address.
Charges and court dates are on Alacourt. Anyone with a possible warrant should call the sheriff's office or a lawyer before turning themselves in. Alabama Rule of Criminal Procedure 4.3 requires that an arrested person see a judge without unnecessary delay and within 72 hours. Choctaw County cases go through the First Judicial Circuit, shared with Clarke and Washington counties.
Alabama guarantees bail to most defendants. It can be denied in capital cases when proof is evident or the presumption great. It can also be denied after a pretrial detention hearing under Aniah's Law (2022) for murder, first-degree kidnapping, rape, sodomy, sexual torture, domestic violence, human trafficking, burglary, arson, robbery, aggravated child abuse and certain offenses against children, and terrorism. In May 2026, voters added solicitation, attempt, or conspiracy to commit murder and shooting into an occupied building or vehicle (Amendment 1, 81.6% yes). Rule 7.2 suggests $10,000–$60,000 for a Class A felony, $5,000–$30,000 for Class B, $300–$6,000 for a Class A misdemeanor, and $1,000–$7,500 for DUI, but judges may set any amount. Release can be on personal recognizance, an unsecured bond, or a secured bond. Ask the sheriff's office which payment types the holding jail accepts.

Newspapers may also be mailed to an inmate as long as they are shipped directly from the publisher.
Magazines
News, special interest or sports magazines may also be mailed to an inmate as long as they are shipped directly from the publisher. Any magazines that contain profanity, weapons, pornography or other content that is adult in nature will be confiscated by the jail staff and will NOT be delivered to the inmate.
Books
Ask the Choctaw County Jail whether books can be mailed in, and whether they must come straight from a publisher or retailer such as Amazon, Barnes & Noble or Books-A-Million. You can order them directly from your computer and have them shipped to the inmate at the address noted.
Books must NOT contain images or content that are considered excessively violent, pornographic or obscene. Any book that does not meet the Choctaw County Jail standards will be disposed of.
