Muscle Shoals Police City Jail Criminal Court Process
Criminal Court Process for Colbert County Alabama
Tuscumbia is the Colbert County seat, and the courthouse at 201 North Main Street houses both the Circuit Court and the District Court. Six cities, from Muscle Shoals and Sheffield to Cherokee, also run municipal courts. State charges are prosecuted by the District Attorney for the 31st Judicial Circuit, which covers only Colbert County. Arrested adults are usually booked into the Colbert County Jail in Tuscumbia, though two city police departments keep their own lockups; release depends on bail set from the state schedule or by a judge.

Juvenile delinquency goes to the Colbert County juvenile court. Within 14 days of a city or District Court conviction, the person can appeal to Circuit Court for a new trial and may choose a jury.
Holding before trial. The county jail in Tuscumbia is the main holding place for people awaiting trial on state charges. Muscle Shoals police operate a city jail at their Avalon Avenue headquarters, and the Tuscumbia Police Department runs the jail where the county houses women. Sheffield arrestees are typically held by the county or a neighboring city jail; call the arresting agency to learn where someone is. Can't pay an attorney? The first judge you see can assign one.

Misdemeanor (for example, second-degree marijuana possession, third-degree domestic violence, driving while revoked, public intoxication)
A misdemeanor arrest in the Shoals usually means a few hours of booking, then release once bail is posted under the statewide schedule. Domestic violence charges are the main exception: state law holds those defendants until a judge or magistrate reviews release, for up to 24 hours, and the judge can add a no-contact order. Anyone not released gets a probable-cause review within 48 hours of a warrantless arrest (72 hours on a warrant) at the Colbert County Jail or the city facility holding them.
The plea is entered at arraignment, where a defendant may also request counsel. Common endings: dismissal, diversion, fines and costs, probation, or a suspended jail term. City and District Court trials have no jury; one is possible only on appeal to Circuit Court.
Penalty ranges under Alabama law
- Class A misdemeanor (third-degree domestic violence, second-degree marijuana possession): up to a year and $6,000
- Class B: up to six months and $3,000
- Class C (public intoxication): up to three months and $500
- Violation: up to 30 days and a $200 fine
Felony (for example, third-degree theft, possession of methamphetamine, breaking and entering a vehicle, third-degree burglary)
Colbert County felony suspects are held at the Colbert County Jail until bond is paid or a final ruling comes. At the first District Court appearance, a judge reviews release terms and rules on appointed counsel.
What happens next
- A preliminary hearing in District Court, if the defense asks, tests probable cause.
- The 31st Circuit district attorney presents the case to a Colbert County grand jury. A true bill sends it to Circuit Court; a defendant may instead waive indictment to plead earlier.
- Circuit Court arraignment, discovery and plea talks.
- The case ends with a plea, a jury verdict or a dismissal.
Class C and D property and drug felonies are covered by presumptive sentencing standards that usually favor probation, drug court or community corrections over prison. Class D carries 1 year and 1 day to 5 years, Class C up to 10 years, Class B 2 to 20, and Class A 10 to 99 years or life. The Habitual Felony Offender Act stretches those ranges for people with prior felonies. Defendants under 21 when the crime occurred may ask for youthful offender handling, which keeps files sealed and caps the term at three years.
Violent felonies (first-degree assault, robbery, manslaughter)
People charged with violent felonies in Colbert County can spend a long stretch at the Colbert County Jail. Aniah's Law allows the prosecutor to request a hearing to deny bail outright in murder, first-degree robbery or burglary and like cases. Amendment 1 of May 19, 2026 brought Colbert attempted-murder cases and shootings into occupied buildings or cars under the same rule. Any bond granted is usually high, with GPS or house-arrest conditions.
Most go through a grand jury, and major Tuscumbia cases may need one to two years before trial. Manslaughter is a Class B felony carrying 2 to 20 years; first-degree assault is also Class B. Robbery in the first degree is Class A, and using a firearm or deadly weapon triggers a 20-year minimum. Capital murder brings death or life without parole; Alabama executes by lethal injection or nitrogen hypoxia. Appointed lawyers in these cases must meet experience requirements for the charge.
Juveniles (under 18) arrested in Colbert County
Colbert County has its own regional youth facility: the Tennessee Valley Juvenile Detention Center, 2216 Missouri Street, Tuscumbia, (256) 381-3520. It also serves neighboring counties. Juvenile probation screens each case, and the juvenile judge hears contested matters in closed hearings.
A child placed in detention must get a detention hearing within 72 hours. Juvenile court usually does not use money bond; instead the judge weighs a safe release to a parent, at times with a curfew or monitor. Families unable to pay get a court-appointed lawyer.
Juvenile cases can close with an informal adjustment, a consent decree, probation, or commitment to the Alabama Department of Youth Services. Youths aged 16 or 17 accused of a capital offense, a Class A felony, drug trafficking, or a felony involving a deadly weapon or causing death or serious injury start in adult court automatically. A transfer hearing can move other cases involving children 14 and older to adult court.
Federal cases (U.S. District Court) from Colbert County
Federal prosecutions from Colbert County belong to the Northwestern Division of the U.S. District Court for the Northern District of Alabama, which sits in Florence. Gun or drug trafficking, fraud and crimes on federal land are typical federal matters. Here that means the Tennessee Valley Authority reservation at Muscle Shoals and Wilson Dam, and the Natchez Trace Parkway near Cherokee.
A magistrate judge conducts the first appearance and decides on bail or detention; contested detention hearings follow the Bail Reform Act. Indictment must come within 30 days of arrest, and trial within 70 days under the Speedy Trial Act, minus excluded time. Federal sentencing uses the U.S. Sentencing Guidelines; without parole, prisoners serve about 85 percent before supervised release. Detainees held for the U.S. Marshals can appear on a county roster too; for a person already in federal prison, try the Federal Bureau of Prisons inmate locator.
Appeals from the Florence court go to the Eleventh Circuit Court of Appeals in Atlanta.
