Talladega County Criminal Court Guide

State courts in Talladega County meet in two places, the Judicial Building on East Street North in Talladega for the Northern Division and the Norton Avenue annex in Sylacauga for the Southern Division. Circuit Court takes felonies and jury trials; District Court takes state misdemeanors, traffic and juvenile matters.

Six cities run their own courts for local arrests. The 29th Judicial Circuit, made up of Talladega County alone, has its own District Attorney. Sheriff Jimmy Kilgore oversees the Talladega County Jail on East Renfroe Road, where an inmate stays until bail is met or a judge sets release terms.

When an arrest happened overnight, look the person up on Talladega County Inmate Search. Circuit and district judges in the 29th Circuit hold court in both the Talladega Judicial Building and the Sylacauga annex. Whichever building hears the case, a defendant in custody stays at the Talladega County Jail.

1. Talladega and Sylacauga courts and city courts

Picking the right Talladega County court. A city officer's ordinance or misdemeanor charge stays in that city's court. Deputies and troopers send misdemeanors to District Court in the division that covers the place of arrest: Talladega for the north, Sylacauga for the south. Felonies open with a District Court warrant and move up to Circuit Court after a grand jury returns an indictment. City and district judges hear cases with no jury, and the defendant gets a new jury trial in Circuit Court by appealing. Youths under 18 begin in juvenile court.

The jail that holds Talladega County cases. State-charge arrests from both divisions are booked at the Talladega County Jail. The City of Lincoln says it contracts its jail needs with the county jail, which it calls the Metro Jail. FCI Talladega and the Childersburg state work center are prisons, not holding places for local pretrial cases. Call (256) 761-2000 to learn where a person is held.

Once booked at the Talladega County Jail, a person with a Talladega County misdemeanor may leave by meeting the state bail schedule by paying cash, pledging land or hiring an Alabama bondsman. Anyone still locked up on East Renfroe Road must see a judge or magistrate within 72 hours (Rule 4.3).

Steps in a Talladega County misdemeanor

  • A first setting in District Court in Talladega or Sylacauga, or in the city court that filed the charge.
  • Talks with the prosecutor; some first offenders may be offered diversion.
  • A plea or a trial before the judge, with 14 days to appeal for a new jury trial.

  • Class B carries half a year at most and $3,000; Class C carries three months and $500; a violation carries 30 days.

3. Talladega County felonies: burglary, stolen goods, meth, forgery

A felony defendant remains at the Talladega County Jail until bond is posted. The first appearance covers release terms and gives the defendant a chance to request appointed counsel.

Felony path in the 29th Circuit

  1. A District Court preliminary hearing, when the defense asks for one, testing whether probable cause exists.
  2. A Talladega County grand jury looks at the case; an indictment moves it to Circuit Court, or the defense may skip indictment to enter an early plea.
  3. Arraignment and motions in Circuit Court, then a plea or a jury trial in Talladega or Sylacauga.

Talladega County felony ranges

  • Class B, such as first-degree theft of $2,500 or more: 2 to 20 years and a fine reaching $30,000.
  • Class C, including forgery in the second degree and burglary in the third degree: more than a year up to 10 years, with a fine reaching $15,000.
  • Class D, such as possessing a controlled substance: more than a year up to 5 years, with a fine reaching $7,500.

Alabama's presumptive standards steer many nonviolent Talladega County Class C and D convictions toward supervision or a brief split term. Prior felonies lift the range through the Habitual Felony Offender Act. A defendant who was under 21 at the time of the crime can ask a Talladega County judge for youthful offender status, which seals the record and caps any sentence at three years.

When a bond is set, the judge can add terms such as electronic monitoring.

Talladega County violent felony penalties

  • Class A, including murder, first-degree robbery and first-degree rape: 10 to 99 years or life, a fine reaching $60,000, and higher minimums when a gun is used.
  • Second-degree assault, a Class C felony: more than a year up to 10 years.
  • Capital murder in Talladega County carries one of two sentences: life with no parole, or death.
