The person is booked, photographed and searched, and then must see a judge without unnecessary delay, generally within 48 hours (Arkansas Rule of Criminal Procedure 8.1). Arkansas guarantees bail before conviction for every charge except a capital offense where the proof is evident or the presumption great (Ark. Const. art. 2, §8). At that first appearance, the judge considers releasing the person on their own recognizance or with conditions, and sets money bail only if no other condition will reasonably ensure they return to court (Rules 9.1–9.2).
