Getting out on bond in Baker County

Within 24 hours, a Baker judge sees the person at first appearance, often over a video link from Macclenny, and picks a release type:

  • Release on recognizance: the person signs and walks out owing nothing.
  • Cash bond: the full sum is posted, and it comes back after the case minus court costs.
  • Surety bond: a bail agent posts it for a fee of 10 percent, with a $100 floor on each count.

Probation violations and out-of-county warrants can still keep a person in Macclenny after bond is paid. A missed court date usually brings a fresh warrant. See our Baker County bail page for payment steps.

How an ICE detainer works in Baker County

  • Macclenny booking sends fingerprints to FBI and DHS records.
  • ICE can then lodge Form I-247A, asking the jail to hold the person.
  • The hold can last up to 48 hours beyond when Baker would otherwise release them, and weekend days and holidays are included in that count.
  • Per F.S. 908.105, the bond judge is told about the detainer, it is noted in the court record, and the state attorney is notified.
  • Per F.S. 907.041, a Baker defendant charged with a forcible felony and found to lack lawful status stays in until first appearance, where the judge presumes detention; that presumption can be challenged.
  • F.S. 908.11 makes each Florida sheriff running a jail enter a 287(g) agreement. Baker's sheriff appears on ICE's list for the Task Force Model and Warrant Service Officer.
  • Look for a detainee on locator.ice.gov, or contact the ICE Miami field office at 2805 SW 145th Ave., Miramar, FL 33027, 954-843-5800.
