Ada County says bonds are paid in person at the counter in the lobby of the main sheriff's building at 7200 Barrister Drive. It accepts, at the Idaho City counter, cash, money orders, cashier's checks, or a bail bond service. Personal checks and credit cards are not allowed.

Ada charges a $25 administration fee for each bond. For counter hours, call 208-577-3000 before you go. The lobby has an ATM, but your bank sets its limit.

Idaho's statewide misdemeanor bond schedule, in its January 2023 version, lists $500 for a first DUI by an Idaho resident and $2,000 for a nonresident. A second DUI is $1,000 for residents and $3,000 for nonresidents. Resisting an officer is $300, and a misdemeanor not named on the list is $300. Usually not. A judge must see the person first. Idaho Criminal Rule 5 requires that first appearance without unreasonable delay, and no later than 24 hours after arrest, leaving out Saturdays, Sundays, and holidays.

A weekend arrest can therefore mean waiting until Monday. The magistrate then sets the amount, and the arrest warrant's stated amount stays unless the judge finds good cause to change it.

At the hearing the judge can set an amount and add rules, such as staying away from the other person. Breaking those rules can cost the person their bail under Idaho Code 19-2919.

It can. Under Idaho Code 19-2909, the real property must be in Idaho and carry enough equity to cover the bail plus the cost of collecting it, after existing liens. The judge may say no, and the person pledging pays all fees.

Posting bail in Idaho City is allowed, yet Idaho City release may be slowed at the Boise County contract jail. For a Boise booking, expect these steps:

1. At the Boise County booking desk, Idaho Code 18-9008 directs staff to find out whether a Idaho City prisoner holds foreign citizenship and, if the Boise County check says so, alert the Department of Homeland Security within 48 hours.
2. ICE may file a Form I-247A detainer asking Boise County to keep the arrested person.
3. Idaho jails, including Boise County's, must honor a reasonable detainer under Idaho Code 18-9005(4) when the Idaho City case's own hold has ended, with notice from Boise jailers that the detainer is the reason.
4. After a Boise release order, Idaho City may hold the defendant 48 more hours, including weekends and holidays.
5. Staff based at the ICE Boise office, 1185 S. Vinnell Way, Boise, ID 83709, 208-685-6635, collect the person from the Boise County jail; ICE often moves Boise detainees to the Elmore County Detention Center at 2255 East 8th North, Mountain Home and then a Boise detainee may go out of state.
6. Search the ICE Online Detainee Locator System with the Boise detainee's A-number, or the Boise County person's name and birth country.
