Call before you drive. The jail is on Albion Avenue and the county's court buildings are on Overland Avenue, so ask the jail desk at 208-878-1000 where bond is taken and during what hours.

Idaho court rules allow cash, a cashier's check, or a money order for bail. A personal check or a card is accepted only when the court has approved it (Idaho Criminal Rule 46). A court cannot demand cash only.

The statewide misdemeanor schedule that took effect on January 4, 2023 covers Cassia County too. A first drunk driving charge is $500 for an Idaho resident and $2,000 for a driver from out of state. A second is $1,000 and $3,000. Resisting or obstructing is $300, and misdemeanors without their own line also get $300.

A bondsman must be licensed through the Idaho Department of Insurance. State law has the agent collect the rate the bond company filed, and bars a charge for the agent's own service. A few expenses can be repaid, and some have a $50 limit (Idaho Code 41-1042).

A judge may deny bail only in narrow situations, for instance a capital charge in Burley backed by clear proof. After a Cassia County plea or conviction, during an appeal, or for a probation violation, the judge chooses (Idaho Code 19-2903).

Minors are not on the adult roster. Cassia and Minidoka counties jointly run the Mini-Cassia Juvenile Detention Center, 718 H Street, Rupert, 208-436-7199. Call there and ask whether your child is held.

The county also has a juvenile probation department, which you can reach through the county site. A judge reviews the detention soon after intake.

The court can forfeit the bond and issue a warrant. A motion to cancel the forfeiture must be filed within 180 days. If your loved one appears in that time, the Cassia County judge must restore the bond, though travel costs may be charged (Idaho Criminal Rule 46).

Federal rules control in Cassia County. A federal warrant served in Cassia County sits outside the Cassia bail chart, so the Burley jail desk takes no money for it. Cassia County federal cases go to the U.S. District Court for the District of Idaho, Eastern Division, 801 E. Sherman St., Pocatello; and Cassia County families can reach the clerk at 208-478-4123.

• The federal magistrate calls the Cassia County case first after agents bring the person from Cassia County, often the next court day.
• No printed cash amount exists for a Burley federal arrest. Applying 18 U.S.C. 3142, the magistrate can release the Cassia defendant on conditions or order detention.
• A requested detention hearing for the Cassia County defendant follows quickly, unless a Cassia party asks to delay it.
• Before trial the U.S. Marshals Service keeps custody, so a Cassia prisoner may be housed in a county jail that rents beds; call 208-878-1000 and ask the Cassia County desk if the person is there.

Posting bail in Burley is allowed, yet Burley release may be slowed at Mini-Cassia Criminal Justice Center. This is how it plays out in Cassia County:

1. When the defendant is booked in Cassia County, Idaho Code 18-9008 requires the jail to decide whether the Cassia prisoner is foreign-born and, if the Cassia County check says so, alert the Department of Homeland Security within 48 hours.
2. ICE may send a Form I-247A detainer asking Cassia County to keep the person.
3. The Burley jail must follow a reasonable detainer under Idaho Code 18-9005(4) after the Cassia case no longer holds them, and Cassia staff must tell the person about it.
4. After a Cassia release order, Burley may hold your family member 48 more hours, including weekends and holidays.
5. Staff based at the ICE Twin Falls office, 212 Deere Street, Twin Falls, ID 83301, 208-737-3820, come to Burley for the pickup; the next stop after Burley can be the Elmore County Detention Center in Mountain Home and then a Cassia detainee may go out of state.
6. Look up the ICE Online Detainee Locator System with the Cassia detainee's A-number, or the Cassia County person's name and birth country.

Get legal advice before posting in Burley, because the bond only covers the Cassia County charge.
