A judge does, usually a magistrate at the first hearing. Idaho law says anyone charged in Clark County and not freed on their own promise is entitled to bail, except for offenses that can bring death when the proof is clear (Idaho Code 19-2903).

A person who was arrested must be brought before a judge without unnecessary delay, and within 24 hours of arrest if you leave out weekends and holidays (Idaho Criminal Rule 5).

Every Idaho county uses the same misdemeanor bail list, the Supreme Court schedule effective January 4, 2023. It sets a first drunk driving arrest at $500 for Idaho residents and $2,000 for others, and a second at $1,000 and $3,000. Resisting an officer is $300. A general line for other misdemeanors is also $300.

In a domestic battery, stalking, or no-contact order case, no bond is set until the first court appearance. A judge can raise, lower, or drop any listed number, since the schedule is advisory (Idaho Misdemeanor Criminal Rule 13). Idaho rules name cash for the full amount, cashier's checks, and money orders. Personal checks and cards are allowed only if the court has approved that method (Idaho Criminal Rule 46). A court may not insist on cash alone.

A bail agent must hold a license from the Idaho Department of Insurance and charge the rate the bond company filed. The agent may not charge for personal service (Idaho Code 41-1042).

Maybe. A magistrate must approve a Clark County property bond. The land must be in Idaho, and for a Clark County bond its equity after loans must at least equal the bail. All title owners sign a Clark County promissory note to the county, and the paperwork is recorded before the person is released (Idaho Criminal Rule 46).

Only in limited cases. A charge that can carry the death penalty, with proof evident or the presumption great, is one. After a plea or finding of guilt, during an appeal, or on a Clark County probation violation, the judge decides case by case (Idaho Code 19-2903).

Dubois and other small towns in the county may rely on the sheriff's deputies. If another agency, such as the state police or a neighboring sheriff, made the arrest, ask that agency which jail has the person.

Young people are handled in magistrate court, and juveniles are not shown on the adult search. The county commissioners review state juvenile corrections reports, but that does not tell you where one child is. Ask the judge for a public defender at the first hearing. Clark County has no Clark County defender office. Contract lawyers are overseen by the Idaho State Public Defender, which answers in Boise at 208-605-4575.

The judge can declare the Clark County bond forfeited and issue a warrant. A motion to set aside the forfeiture must be filed within 180 days. If the person appears in that period, the judge must restore the bond, though costs of bringing the person back may be charged (Idaho Criminal Rule 46).

A federal court takes the Clark County case. A federal warrant served in Clark County is not part of the Clark bond schedule, and Clark deputies cannot set an amount for it. Clark County federal cases go to the U.S. District Court for the District of Idaho, Eastern Division, 801 E. Sherman St., Pocatello; the clerk takes Clark County questions at 208-478-4123.

• A magistrate in the Eastern Division runs the first hearing in the Clark matter for a Clark County arrest, often the next court day.
• No printed cash amount exists for a Dubois federal arrest. Following 18 U.S.C. 3142, the judge can release the Clark defendant on conditions or order detention.
• A requested detention hearing for the Clark County defendant follows quickly, unless a Clark party asks to delay it.
• The U.S. Marshals Service has custody before trial, and a jail near Dubois may hold them under contract; call 208-374-5403 and ask if the Dubois jail has the arrested person.
• When the Dubois federal case ends in prison time, the Federal Bureau of Prisons sets the place, and the Federal Bureau of Prisons inmate locator tracks it.

Posting bail in Dubois is allowed, yet ICE may still claim the Clark person at Clark County Jail. The steps usually run like this for a Dubois arrest:

1. At the Clark County booking desk, Idaho Code 18-9008 requires the jail to decide if the Clark prisoner is foreign-born and report that to the Department of Homeland Security inside 48 hours.
2. ICE may send a Form I-247A detainer to the Clark County jail staff.
3. A reasonable detainer must be honored in Clark County under Idaho Code 18-9005(4) when the Dubois case's own hold has ended, and Clark staff must tell the person about it.
4. Once bail on the Clark County charge is paid, ICE gets a Clark County window of up to 48 hours, and Saturdays, Sundays, and holidays count.
5. Officers from the ICE Idaho Falls office, 2075 N Boulevard, Idaho Falls, ID 83402, 208-535-5100, pick the person up in Dubois; ICE often moves Clark detainees to the Elmore County Detention Center at 2255 East 8th North, Mountain Home or, from Clark County, to facilities in other states.
6. Check the ICE Online Detainee Locator System by Clark A-number, or by the Dubois detainee's name and native country.

Get legal advice before posting in Dubois, because the bond only covers the Clark County charge.
