Morris County Juvenile Detention Information

Morris County Juvenile Detention Center houses offers secure holding for juveniles who are 12-18 years old. Each will be provided with a court date in front of the judge for a detention hearing within 24 hours of their arrest to determine if they will remain in the detention center while waiting their next court dates or if they will be permitted to return home and trusted to appear at their court date. The detention hearing is held at the detention center through a video conference. Each of the residents will have either a private room or a room that is shared with one other person, and it contains their bed, toilet, sink, bed, mattress, pillow, and a separate private shower is provided for daily showering. Three meals and one snack are provided each day. A nurse and physician will provide an assessment and medical care, while a social worker is onsite around the clock for any crisis intervention or emergent needs, and mental health care is provided on an ongoing basis. Education is provided for core curriculum and high school credits can be earned. Behavior is monitored and good behavior and completed chores can result in higher levels and more privileges. What happens during booking in Morris County?

After being arrested and taken into custody, and after being read their Miranda Rights, an offender will next be transported to the local police or department or the Sheriff’s Department in Morris County for booking.

Booking is very involved and requires multiple steps in the process, however, keep in mind that most attorneys will advise that an offender remain silent and not offer any additional information about the crime they have been arrested for because anything they do say may be recorded and may very well be used against them in court.

What is the booking process like at the Morris County Juvenile Detention?

Booking includes having their photo (mugshot) and fingerprints taken, as well as being asked a lot of questions about their personal history and state of mind. If it’s a serious felony, their DNA may also be taken. They will also be checked for warrants in Morris County and other New Jersey and USA jurisdictions.

If the offender was arrested for a DUI offense, and has refused a breathalyzer test, they may also be forced to have blood drawn by a doctor or nurse.

It is also very likely that the offender will undergo a humiliating full body search while in the nude. This includes bending over, spreading their cheeks in the direction of an officer, and coughing. They will also be walked through a metal detector or x-ray machine, like those used at an airport.

What kind of questions are asked during booking?

The arresting jurisdiction will ask about gang affiliations, tattoos, medical conditions, prescribed medication they are taking, recreational drugs they are on or addicted to, allergies, if they are suicidal, and other relevant information that will help with determining their cell assignment and special needs.

What happens to an offender’s personal property during booking?

During the arrest and booking process an offender will also have all their personal property confiscated and held for either their release from jail, or with the offender’s approval, released to a friend or family member.

Personal property includes the clothing they are wearing, money, wallets, purses, cell phones, jewelry, body rings, earrings, watches, and even glasses if they are deemed a security risk. If they are allowed to keep their shoes or sneakers, the laces are removed.

What happens after booking?

At this point the offender will be allowed to make a free phone call to a person of their choice to notify them of their arrest, and/or arrange a bond or bail for their release.

If the offender is being detained and housed while awaiting arraignment, the Morris County Juvenile Detention will provide a jail garment and slip-on shoes, a blanket, sheets, soap, toothbrush, toothpaste, and a towel.

Often, before they are dressed in the jail outfit and brought to their housing location, they will be forced to take a shower and undergo a disinfectant treatment for body and hair lice, scabies or other pests that may be residing on their person.

How long does the Morris County Juvenile Detention Booking process take?

Booking can take anywhere from an hour to 24 hours or more. It all depends on the number of people that are awaiting processing, the number of staff on duty at the time, and the behavior of the offender.

If the offender is heavily intoxicated and/or violent, the Booking Officer may decide to stick the offender in a holding cell for several hours until they become more manageable.

What is Bail?

Bail is what the arrested in Morris County must pay or do to stay out of jail until the first court appearance. The agreement to bail acts as a promise that the arrested will return to court for court dates and trial. 

Bail usually refers to a dollar amount, but in New Jersey, bail can also mean something that has to be done, or a condition such as reporting to an officer of the court, a curfew, restraining orders or attending a treatment program. 

What is the difference between Bail and Bond?

Bail is what the arrested must pay or do to stay out of jail until the first court appearance. The agreement to bail acts as a promise that the arrested will return to court for court dates and trial. 

New Jersey has mostly done away with the bail/bond system since 2017, except for cases involving unpaid motor vehicle summonses.

Defendants with a serious risk of danger or flight can be detained pending trial. Low-risk defendants will be released. This is called released on their own recognizance in all states. If released, the defendant will be issued a summons to appear to court within 21 days.  

Pretrial service officers will monitor those defendants, based on the conditions of their release while the defendant is out of custody pending rial.

A judge may order a variety of conditions while the defendant is awaiting trial, such as a GPS location monitor, checking in via phone or in person with a pretrial services officer, no contact with an alleged victim, and other conditions similar to probation.

People who are arrested for serious felonies (including first- and second-degree murder, aggravated criminal sexual assault, violent robberies and burglaries, home invasions and vehicular invasions) can still be denied pretrial release.

Prosecutors must request a detention hearing and the decision whether to hold someone will be made at the judge’s discretion.

This ruling will be based on several factors including the likelihood that the defendant will flee or any public safety risk that they may present.  

Does Morris County have bail?  

No, New Jersey is a NO BAIL state.

Under current laws a defendant can only be held if a judge determines they are a risk to the community, likely to interfere with the investigation or fail to show for all required court dates. If the judge determines they are not a risk the defendant is released prior to trial.

What are the different types of bonds in Morris County?

Based on a review of information from the arrest, the judge or bail officer will determine and notify the accused of which release conditions are available to them. Professional bond companies are not permitted to operate in New Jersey.

What kind of bonds are accepted in Morris County? 

Under the new system, if a judge decides a defendant does not pose a public safety or willful flight risk, then they will be released without being required to post any money.
