Crosby County Jail Inmate Bail & Bonds
Crosby County Bail and Release
Grown-ups arrested in any part of this farm county are booked at the Crosby County Jail, a small lockup the Sheriff's Office keeps inside the courthouse at 201 W Aspen St, Crosbyton, TX 79322. This page covers the magistrate, bond choices, the Aspen Street offices that handle money, and holds that can outlast a bond. Our Texas bail laws page is there if you want the fine print for the whole state.
Confirm the booking first. Open the county's jail lookup, or enter part of a name in Texas IVSS-Counties, the state's custody tracker. Our Jail Roster page centers on custody: who is locked up today, the latest Crosbyton-area bookings, open warrants, what the charges are, mugshots, which lawyer is assigned, and getting a wallet or phone back from the jail.
Next, phone the Sheriff's Office at 806-675-7301. Ask three things: has a magistrate seen your person, what is the bail, and where can it be paid? Our court page then tracks the case from Aspen Street to the end.
1. Crosby County arrests: who decides bail, and by when?
A magistrate. From the moment of arrest, a 48-hour clock runs for getting the person before one (Texas CCP 14.06, 15.17). The county's lawyer plan for its district and county courts uses that same 48-hour deadline.
At this brief hearing the magistrate will:
- say what the charge is and list the person's rights;
- explain the steps to get a court-paid lawyer and help with that form;
- fix the bail figure and any release conditions.
District judges, the county judge and a justice of the peace may all serve as magistrates (Texas CCP 2A.151). Locally, the Justice of the Peace can be called at 806-675-2523. The law wants each person's bail decided on its own, inside 48 hours, with the lightest terms that still protect people (Texas CCP 17.028).
Since the 2021 Damon Allen Act, Class B cases and above call for a public safety report before bail is set. The report pulls up history, yet it gives neither a score nor an amount (Texas CCP 17.021, 17.022).
↑ Back to the question list2. Personal bond or bail bond: which can a magistrate order?
Bail in Texas comes in two forms (Texas CCP 17.01 to 17.03):
- Bail bond. A licensed surety promises the full amount, or someone deposits the full amount in cash.
- Personal bond. The accused signs a promise to appear, and no bail money is put up.
Rules can be attached to both, for example keeping away from the home where police were called. Folks out on bond for a second DWI, or certain other alcohol crimes, must put an ignition interlock in their vehicle; it checks breath before the engine starts (Texas CCP 17.441).
Many violent crimes rule out a personal bond. Senate Bill 9 in 2025 made that list longer. When the charge is burglary, a drug felony on the statute's list, or organized crime, the magistrate must defer to the trial judge (Texas CCP 17.03).
For a fine-only charge, a magistrate can release the person with no bond and a written date to come back (Texas CCP 15.17).
↑ Back to the question list3. Does the courthouse use a bail price list?
No statewide chart sets bail by crime. Each magistrate decides the figure after looking at five things (Texas CCP 17.15):
- the accusation and its details;
- how much the family can actually pay;
- danger to the victim, officers and the public;
- past arrests, convictions and the safety report;
- citizenship.
Its job is getting the person back for court dates. Using it to crush someone is forbidden. One firm ceiling exists: when nobody decides probable cause on time after a warrantless arrest, release follows on bail no higher than $5,000 for a misdemeanor or $10,000 for a felony (Texas CCP 17.033).
Texas bail forms are stored on the state's TOPICs site. To hear the actual bail for your person, ring the jail at 806-675-7301.
↑ Back to the question list4. Paying bail at the courthouse jail, step by step
Jail staff can accept bail for the court once they run a record check (Texas CCP 17.20). Work through this list:
- Call 806-675-7301 and ask to talk with the jail.
- Spell out the full name, then the birthday.
- Jot down each charge and its bail. Ask whether anything else, like a warrant, is holding them.
- Ask who collects the money, which payment types work, and what time to come.
- Bring your photo ID and the money to the courthouse at 201 W Aspen St, Crosbyton, TX 79322.
- Keep the receipt, and check that it shows your name.
If you hire a bondsman, the bondsman handles these steps. Release paperwork can run a while, so bring patience.
↑ Back to the question list5. Do the Aspen Street clerks accept bail?
They might, so call first. Both clerks keep criminal files in the courthouse at 201 W Aspen St, Crosbyton, TX 79322:
- District Clerk, Suite 207, 806-675-2071. Felony files for the 72nd District Court.
- County Clerk, Suite 102, 806-675-2334. Files for Class A and B misdemeanors.
Call in business hours. Find out if Suite 207 or Suite 102 will take bond for this case, the payment it wants, and how soon the jail gets word.
↑ Back to the question list6. What money can you bring to the courthouse?
Payment rules change, so call the jail at 806-675-7301 before the drive. If a clerk will take the money, ask that office as well:
- Cash: allowed, and in what exact amount?
- Cashier's check or money order: which payee name goes on it?
- Card: allowed, and with what fee?
Texas returns cash bail, less fees, to whoever the receipt names (Texas CCP 17.02). Put the payer's own name on it. If a stranger calls offering a quick release for cash, hang up.
↑ Back to the question list7. Bondsmen in a county this size: what are the rules?
Bail bond boards license bondsmen in big counties, those of 110,000 or more (Occupations Code 1704.002). Here, the Census Bureau counted roughly 4,852 people as of July 1, 2025, so that rule does not reach this county. A sheriff in a smaller place may instead keep a roll of sureties judged able to pay (Texas CCP 17.141). Ask at the Sheriff's Office for that roll.
Before signing:
- No Texas statute limits the bondsman's fee, so compare a few.
- Every payment or pledged item earns you a receipt; demand it (Occupations Code 1704.305).
- Bondsmen are not allowed to look for clients inside the jail (Occupations Code 1704.304).
- When every case is over, ask in writing for your collateral. The law gives the bondsman 30 days (Occupations Code 1704.301).
- A licensed lawyer already representing the person may sign as surety on that case (Occupations Code 1704.163).
Surrender has rules too. A surety backing out must notify the defense lawyer before filing its affidavit (Texas CCP 17.19).
↑ Back to the question list8. Can holds stop a Crosby County release after bail?
Each bond answers for a single case. Staff at 806-675-7301 can list each hold, so ask before money changes hands. Typical ones:
- Out-of-county warrant. A Crosbyton magistrate is allowed to set bail on a warrant from elsewhere, then forward that bond (Texas CCP 15.18). The other county may still want the person brought over.
- Parole. A parole "blue warrant" usually means no release until the parole matter is heard (Government Code 508.254).
- Probation. Adult probation for this county works out of 701 Main, Lubbock, TX 79401, 806-775-1200. A fresh arrest can trigger a motion to revoke.
- Family violence. After bond, the person stays 4 more hours. A magistrate may order up to 48 (Texas CCP 17.291).
- Immigration. Answer 16 explains ICE detainers.
9. When may a Texas court refuse any bail at all?
Seldom. Our state constitution makes nearly every charge bailable. Capital charges with evident proof stand apart, under art. I, sec. 11 of the Texas Constitution. Other narrow paths to denial:
- A district judge, after a hearing, may hold some repeat felons or people who commit a felony while out on felony bail (sec. 11a).
- Violating certain bond terms or a protective order can cost a person bail (secs. 11b, 11c).
- Sec. 11d arrived with Proposition 3 in the November 2025 election. It reaches murder, aggravated kidnapping, aggravated robbery, trafficking, indecency with a child and a handful of other charges. Only the prosecutor can ask. Proof of flight risk or danger, presented by the prosecutor at a hearing, means bail "shall be denied." Judges who release such a defendant anyway must write down their findings.
Two 2025 changes also matter. Felony bail set by a lower magistrate can be sent up to a district judge at the prosecutor's request (Texas CCP 17.029). The State may even appeal, in some violent cases, what it sees as too little bail (Texas CCP 44.01).
Your person's prosecutor works from the District Attorney's office, 201 W Aspen St, Crosbyton, TX 79322, phone 806-675-2062. The county site lists that same office as County Attorney.
↑ Back to the question list10. Can bail be lowered later?
Yes, by motion. Your person's lawyer asks the judge in writing. Bring papers that show roots and means: a boss's letter, a rent receipt, proof of family nearby and a dollar figure the family can truly reach. A magistrate has to consider whether the person can pay (Texas CCP 17.15).
A slow prosecution also helps. When prosecutors drag their feet past a set limit, release on a personal bond or smaller bail becomes mandatory (Texas CCP 17.151). The deadlines:
- A felony gets the longest wait, 90 days.
- A jailable misdemeanor carrying over 180 days allows 30.
- Lesser jailable misdemeanors allow 15.
- Fine-only offenses allow just 5.
Some charges are excluded. For felony hearing dates, ask the District Clerk at 806-675-2071. For misdemeanors, ask the County Clerk at 806-675-2334.
↑ Back to the question list11. Free lawyers for Crosby County defendants: how to ask
Someone too broke to hire counsel can request one at the magistrate hearing. The county's plan for appointed lawyers lays out the order:
- The magistrate supplies the form and helps fill it in.
- If that magistrate can't appoint, the form goes to the County Judge inside 24 hours.
- The County Judge names counsel; three working days after the papers arrive is the outer limit (Texas CCP 1.051).
- Contact should follow fast: the lawyer must reach out, or try, the working day after the appointment (Texas CCP 26.04).
The County Judge appoints lawyers in all case types. Reach that office at 806-675-2011. Capital cases go to a regional public defender program for West Texas. Posting bond does not, alone, cancel the right to an appointed lawyer.
↑ Back to the question list12. Where do Crosby County criminal cases go to court?
Every county-level court shares the courthouse at 201 W Aspen St, Crosbyton, TX 79322. The building's main number is 806-675-0208, and offices keep business hours.
- 72nd District Court for felonies. The judge also covers Lubbock County. District Clerk: Suite 207, 806-675-2071.
- County Court: the County Judge's bench, the trial court for Class A and B misdemeanors. County Judge: 806-675-2011. County Clerk: Suite 102, 806-675-2334.
- Justice of the Peace, for tickets and other Class C offenses: 806-675-2523.
Federal court for this area is in Lubbock. The federal answer below has details.
↑ Back to the question list13. How does cash bail come back, or get lost?
Show up to every hearing, let the case finish, and the cash goes back to whoever the receipt names (Texas CCP 17.02). Clerks may subtract up to 5% (never over $50) after a guilty finding or a deferred adjudication order; otherwise the full sum returns (Local Government Code 117.055). Leftover bail can be put toward fines and court costs (Texas CCP 17.53).
Skipping court changes everything. Forfeiture starts with a judgment nisi signed by the judge (Texas CCP 22.01, 22.02). If the missing person is jailed again soon, the surety can escape paying: 180 days is the window on misdemeanors, and 270 on felonies (Texas CCP 22.13). Under Penal Code 38.10, a no-show may also face a brand-new charge for skipping court.
For a refund, contact the clerk on the case: District Clerk 806-675-2071, or County Clerk 806-675-2334.
↑ Back to the question list14. How do jail account money and property get returned?
Sort this out before release day. Call the jail at 806-675-7301 and ask:
- how unused money on the jail account is refunded;
- when stored clothes, wallets, keys and phones can be collected;
- whether a family member may collect them with the person's signed okay.
A photo ID is needed at pickup. For deposits, our jail account money page lays out the usual options.
↑ Back to the question list15. Federal arrests: who rules on release in Crosby County cases?
Lubbock hosts this county's federal court, part of the Northern District of Texas, at 1205 Texas Avenue, Room 209, Lubbock, TX 79401, in the Mahon federal building. Clerk's office: 806-472-1900.
- Early on, a federal judge in Lubbock hears both sides and orders release or detention (18 U.S.C. 3142).
- Marshals in Lubbock keep people who are held for trial: 1205 Texas Avenue, Room C-126, Lubbock, TX 79401, 806-472-7655.
- Defendants short on money may be assigned the Federal Public Defender: 1205 Texas Avenue, Room 507, Lubbock, TX 79401, 806-472-7236.
- For someone serving federal time, try the Federal Bureau of Prisons inmate locator.
16. ICE detainers: does a paid bond end one?
It does not. Bail paid on Aspen Street leaves an ICE hold standing. In order:
- The jail receives an ICE request called Form I-247A.
- That form asks Crosbyton jailers to keep the person up to 48 hours after they would otherwise be released so ICE can collect them (8 CFR 287.7(d)).
- Texas jails have to honor detainers, but people who prove citizenship or lawful presence go free (Texas CCP 2A.060). Since 2017, a Texas law has barred any local policy limiting immigration enforcement (Government Code 752.053).
- Each jail-running county now faces a 287(g) deadline. Under Senate Bill 8, passed in 2025, the cutoff for asking ICE to sign is December 1, 2026. To learn where Crosbyton's jail stands, phone the Sheriff's Office at 806-675-7301.
- ICE then chooses a holding site. Search for them with the ICE Online Detainee Locator, using a name plus country of birth.
17. Where are long sentences from the 72nd District Court served?
A state jail felony, the bottom felony rung, carries six months to two years (Penal Code 12.35). That time goes in a state jail unit. Any felony from third degree upward means time in a TDCJ prison. New arrivals pass through intake before TDCJ picks a unit suited to them.
- Names and TDCJ numbers can be checked in the TDCJ inmate search. Its data runs about a day behind.
- Facility write-ups live on our Texas state prisons page.
18. Under 17 and jailed in Crosby County: what now?
Family Code 51.02 puts a child of 10 through 16 in juvenile court. At 17, Texans are tried with the grown-ups. Detained youths get a judge's review within two working days, or within one working day when Friday or Saturday was the arrest day (Family Code 54.01). Before that review, a lawyer gets appointed.
On the state's registry of youth detention centers, this county has none of its own. Lubbock's center is on that list: Lubbock County Juvenile Justice Center, 2025 N Akron Ave, Lubbock, TX 79415, 806-775-1800. To learn where a local teen was taken, ask the Sheriff's Office at 806-675-7301.
