1. Is my relative in the Vilas County Jail?

Put the full name into Vilas County Inmate Search. A finished booking displays the charge and the bail. A booking that is only minutes old can take a little while to post.

Then call the Sheriff's Office at 715-479-0601 with the name and birth date. Ask the arresting police agency for a report number as well.

2. Where are people arrested in Vilas County held?

The county jail in Eagle River holds them. Deputies secure the inmates, and the Sheriff's Office address is 330 Court Street, Eagle River, WI 54521.

Vilas County keeps its own prisoners. Wisconsin has no state jail that takes the place of a county jail.

3. I live out of state and my family member was arrested on vacation. What now?

Wisconsin rules apply to everyone arrested here, whatever the home state. The person is held until released on conditions, so start with Vilas County Inmate Search and the Sheriff's Office at 715-479-0601.

A judge usually sets release terms at the first appearance. The Clerk of Circuit Court at 715-479-3632 gives the date. Ask whether the judge will let the person leave Wisconsin, since travel limits are a common condition.

4. Can I pay bail from another state?

Ask the Sheriff's Office how it takes payment for that booking. Wisconsin lets an officer take bail only at a sheriff's office or police station, and lets the clerk accept a credit or debit card.

Never wire money to a person who calls you. Confirm the amount and the method yourself at 715-479-0601 before sending a dollar.

5. Is there a Vilas County bail bondsman?

No. State law says a surety must be a person living in Wisconsin and that no surety may be paid. Wis. Stat. 969.12 leaves no room for a bonding business.

Websites that promise a licensed Vilas County bondsman are mistaken. Real bail is the court's own money requirement.

Back to questions ↑

6. What is bail, as opposed to other release terms?

Bail is only money. A curfew, a travel limit, a ban on weapons, or a no-contact order is a condition of release. Conditions with no cash are common.

Money bail needs a finding that it is reasonably necessary to assure the person appears. With a violent-crime charge the judge may weigh the whole picture, including prior violent convictions.

Back to questions ↑

7. Will the person have to pay anything to leave?

Not always. A judge can release on a promise to appear or on an unsecured appearance bond with money owed only if the bond is broken. A judge may also place the person in the custody of a responsible person.

Police release most misdemeanor arrests without cash unless the person has no ID, is dangerous, has no community ties, missed court before, or the investigation needs to continue.

8. What if Lac du Flambeau Tribal Police made the arrest?

The Lac du Flambeau Tribal Police Department is at 623 Peace Pipe Road, 715-588-7717. Ask that department which court the charge is in, tribal or Vilas County, and where the person is held.

A state charge brings a Vilas County judge and Wisconsin bail rules. A tribal charge follows tribal court procedure.

9. How soon will a judge see my family member?

A judge must see the person within a reasonable time, and must find probable cause within 48 hours of an arrest made without a warrant. Courts can hold the hearing by live video.

Weekend and holiday arrests wait for the next court day. Call the Clerk at 715-479-3632.

Back to questions ↑

10. Who can co-sign?

Only an unpaid adult who lives in Wisconsin. The judge can order a sworn statement that the signer can cover the bond and decides what else proves it.

The law has no set deed or mortgage routine, so ask the Clerk before pledging a cabin or lot.

Back to questions ↑

11. Can a judge deny bail altogether?

Yes, in narrow cases. A prosecutor can ask to hold a person charged with listed serious crimes, or a violent crime plus a prior violent conviction. The hearing begins no later than 10 days after detention.

The state's burden is clear and convincing evidence. Bail can then be denied for up to 60 days after the hearing.

Back to questions ↑

12. What if the arrest followed a domestic dispute?

Officers must arrest in many cases and cannot release the person until bail is posted or a judge appears. A signed notice of the rules comes before release.

For three days after the arrest, the person stays away from the victim's home and does not make contact. A knowing violation can cost a $10,000 fine, nine months in jail, or both.

Back to questions ↑

13. Is Vilas County bail money refundable?

A deposit returns to the payer when the case is dismissed or ends in acquittal. After a conviction it goes to restitution first, then the judgment, and the rest comes back.

A broken bond term can mean forfeiture, with mailed notice and judgment possible after 30 days.

Back to questions ↑

14. What if the person goes home to another state and misses court?

A missed date brings a warrant and can bring a bail jumping charge, a Class A misdemeanor after a misdemeanor release and a Class H felony after a felony release.

Give the clerk any new address in writing within 48 hours. Wisconsin lets some hearings run by live video, so a lawyer can ask the judge whether a remote appearance is allowed.

Back to questions ↑

15. Is there a public defender for Vilas County?

Request a public defender when the judge first calls the case. The State Public Defender office in Rhinelander, 158 South Anderson Street, Suite 1, covers Vilas County at 715-750-2170.

A lawyer can ask for lower bail, and a person held 72 hours after the first hearing can request a review.

Back to questions ↑

16. What happens to a minor arrested in Vilas County?

Children go through juvenile court, not the adult search. The Clerk at 715-479-3632 has hearing dates, and the Sheriff's Office at 715-479-0601 can say whether a child is in custody.

Wisconsin counts twelve county-run secure juvenile detention centers, so a child may be held outside Vilas County.
