Chilton County Jail Criminal Court Process
Criminal Court Process for Chilton County Alabama
Chilton County Criminal Court Guide
Clanton is the county seat; its courthouse at 500 Second Avenue North holds the Circuit Court (felonies) and the District Court (state misdemeanors, preliminary hearings, juvenile cases). Clanton, Jemison, Maplesville and Thorsby run municipal courts for arrests by their own police.
Prosecution belongs to the District Attorney for the 19th Judicial Circuit, whose territory is Autauga, Chilton and Elmore counties. Anyone arrested in Chilton ends up at the Chilton County Jail in Clanton, where they stay unless they post bail or a judge signs a release order.
Before driving to the courthouse, search Chilton County Inmate Search. Circuit judges and prosecutors split time among Chilton, Autauga and Elmore; Clanton has a resident district judge. Defendants who are locked up are transported from the Chilton County Jail for each setting.
1. Local courts in Chilton County (circuit, district, juvenile and town courts)
- Circuit Clerk, Chilton County Courthouse, 500 2nd Ave. N., Clanton, (205) 755-1551 or (205) 755-4275 (either line reaches the clerk)
- District Attorney, 19th Judicial Circuit, Clanton office, (205) 755-4242
- Chilton County Sheriff's Office, 53 Robert Threlkeld Pkwy., Clanton, (205) 755-4698
- Chilton County Jail, 301 City Street, Clanton, (205) 755-1053; sheriff's after-hours line (205) 755-1120
- Court-appointed counsel: ask the Circuit Clerk
- Clanton Municipal Court, 601 1st Ave., Clanton, (205) 755-6669
- Juvenile court and probation, Circuit and District Court clerk, Clanton, (205) 755-4275
Sorting out the court. A misdemeanor or ordinance arrest by a Clanton, Jemison, Maplesville or Thorsby officer inside town limits is normally set in that town's court. Deputies and troopers file in District Court. A Chilton felony opens in District Court and reaches Circuit Court once indicted. Town and district courts have no juries, so a conviction there can be appealed for a new jury trial in Circuit Court.
Holding before trial. The Sheriff's detention division runs the county jail on City Street and books arrestees from every agency in the county. Town officers book people at their own station, then drive anyone still held over to the county lockup. Calera arrests on the Chilton side may go to the Shelby County Jail instead.

Unincorporated areas such as Verbena and Lake Mitchell have no town court, so charges there go to District Court. On state charges, filing a hardship affidavit with the clerk may produce an appointed private attorney paid by the state; town courts appoint their own lawyers. Questions about a town warrant or bond go to that town's magistrate.
↑ Back to the question list2. Misdemeanor (for example, reckless driving, third-degree criminal trespass, second-degree marijuana possession, DUI)
For most misdemeanors, the Chilton County Jail releases a person once the scheduled bail is paid in cash, secured by a professional bondsman, or backed by a property bond, and some defendants are released on their own signature. Anyone still held must see a judge or magistrate within 72 hours (Rule 4.3).
Typical sequence
- Arraignment in District Court in Clanton or in the arresting town's court.
- A pretrial conference where many cases end in a plea, reduced count, or diversion.
- A non-jury trial when there is no deal; a conviction can be appealed to Circuit Court within 14 days.
What a Chilton County misdemeanor can bring
- Class A (second-degree marijuana possession): as much as 12 months behind bars plus a fine reaching $6,000.
- Class B: six months and $3,000 at most; Class C: three months and $500. Third-degree criminal trespass is a violation (up to 30 days).
- Reckless driving and a first DUI each carry jail exposure; DUI adds a $600 to $2,100 fine and license suspension.
Facing possible jail without funds for counsel? Raise it with the Clanton judge right away.
↑ Back to the question list3. Felony charges (drug possession, third-degree burglary, gun theft, identity theft and the like)
Felony defendants remain at the Chilton County Jail until bond is posted. The first appearance covers release terms and appointed counsel.
The 19th Circuit felony process
- A preliminary hearing in District Court if the defense requests it.
- Grand jury review in Clanton; indictment can be waived to settle sooner.
- Circuit Court arraignment and motions, then plea or jury trial; with judges covering three counties, this often takes nine months to a year or more.
Felony penalty ranges
- Class B (first-degree identity theft, first-degree theft): two to twenty years in prison, fines reaching $30,000.
- Class C (third-degree burglary, theft of a firearm as second-degree theft): 366 days to 10 years, fines reaching $15,000.
- Class D (simple drug possession): 366 days to 5 years, fines reaching $7,500.
Presumptive sentencing in Alabama sends a good share of lower-level, nonviolent felons to probation or community corrections; earlier felonies raise the ceiling under the Habitual Felony Offender Act. Defendants under 21 at the time of the offense can seek youthful offender status, which seals the record and limits punishment to three years.
↑ Back to the question list4. Violent felony charges (murder, first-degree assault or robbery, shooting into an occupied home and similar)
Expect a longer stay at the Chilton County Jail on a violent charge. Aniah's Law (2022) lets the District Attorney request a hearing to deny bail after a hearing for murder, first-degree assault, first-degree robbery and other listed crimes. Chilton prosecutors gained the same option for attempted murder and gunfire into occupied homes or vehicles under Amendment 1 on May 19, 2026.
Punishment
- Class A (murder, first-degree robbery): 10 to 99 years or life, fines as high as $60,000, and mandatory add-ons for firearms.
- Shooting into an occupied dwelling and first-degree assault: Class B.
- Capital murder: life without parole or death (lethal injection or nitrogen hypoxia).
These cases frequently take more than a year. Appointed counsel represents defendants who cannot pay, with specially qualified lawyers on capital charges.
↑ Back to the question list5. Juveniles (under 18) arrested in Chilton County
Chilton County's juvenile cases are heard by the district judge sitting as juvenile court, and juvenile probation officers do intake: release to a parent, an informal adjustment, or a formal delinquency petition. Chilton has no youth jail of its own; a child who must stay locked up usually goes to a regional center licensed by the Department of Youth Services, such as the Shelby County Regional Juvenile Detention Center in Columbiana or the Montgomery County Youth Facility. Children do not post adult bail; Ala. Code §12-15-207 guarantees a detained child a detention hearing within 72 hours.
Results in juvenile court
- Informal adjustment without adjudication.
- Probation supervised in Clanton.
- Commitment to the Alabama Department of Youth Services for serious offenses or repeated violations.
Transfer to adult court
Ala. Code §12-15-204 requires adult prosecution of 16- and 17-year-olds charged with a capital offense, a Class A felony, a felony involving a deadly weapon or dangerous instrument, a felony causing death or serious physical injury, or drug trafficking; such teens may be held at the Chilton County Jail. For youths 14 and older, prosecutors may seek a §12-15-203 transfer hearing. Counsel is appointed if the family cannot pay.
↑ Back to the question list6. Federal cases (U.S. District Court) from Chilton County
Although Chilton borders Shelby County, it is not in the Northern District. 28 U.S.C. §81 assigns it to the Middle District of Alabama's Northern Division, which sends cases to the Montgomery federal courthouse. Federal charges arise from federal crimes such as I-65 drug trafficking, prohibited-person gun possession or benefits fraud. The county has no military base or tribal land, and Public Law 280 does not apply in Alabama.
- U.S. Attorney's Office for the Middle District: 131 Clayton St., Montgomery, (334) 223-7280
- Federal defense: the court appoints a federal defender or panel attorney for anyone who cannot pay
The federal path
Someone arrested federally is first brought to a U.S. magistrate judge, who holds a detention hearing and either orders the person held without bail or sets release conditions under the Bail Reform Act. Indictment follows within 30 days; the Speedy Trial Act's 70-day trial deadline is often extended. Sentencing follows the U.S. Sentencing Guidelines; with parole abolished, inmates complete about 85% of their time before supervised release. Any appeal heads to the Atlanta-based Eleventh Circuit. Federal detainees held for the U.S. Marshals may be listed on a county roster, including the Chilton County Jail. For anyone already sentenced, use the Federal Bureau of Prisons inmate locator.
