Shelby County Jail Criminal Court Process
Criminal Court Process for Shelby County Alabama
Columbiana is the Shelby County seat, and the courthouse on North Main Street holds Circuit Court for felonies and jury trials and District Court for state misdemeanors, preliminary hearings and juvenile matters. Over a dozen Shelby cities keep a municipal court for cases their police bring. Shelby County is a circuit by itself, the 18th, and its District Attorney prosecutes every state charge. Sheriff John Samaniego runs the Shelby County Jail on McDow Road, where a magistrate or judge sets bail for adults booked on state charges. Before looking up a hearing date, try Shelby County Inmate Search.

Which Shelby court takes the case. A city officer's ordinance charge, or a misdemeanor within that city's police limits, is heard in that city's own court. Sheriff's deputies, state troopers and officers from towns with no court send misdemeanors to Shelby County District Court in Columbiana. Felonies begin in District Court and move up to Circuit Court once a grand jury indicts. Neither District nor municipal court has a jury, so a person convicted there can appeal within 14 days for a fresh (de novo) Circuit Court trial. Anyone under 18 goes to juvenile court unless an Alabama statute moves the case up to adult court.
Shelby jail locations before trial. The Sheriff runs the county jail at 380 McDow Road, which also holds people for other agencies. Alabaster, Pelham, Helena and Calera police can keep a person briefly at their own station before a state-charge arrest is moved to McDow Road. Hoover, which crosses the Jefferson-Shelby line, runs its own jail at 2020 Valleydale Road, so Hoover arrests on the Shelby side can start there.

- Wilsonville: ask Town Hall, 9905 N. Main St., (205) 669-6180, whether a charge is set in town court or District Court
- Westover: the town relies on the Sheriff's Office for patrol; ask City Hall, (205) 678-3375, where a citation is heard
- Indian Springs Village: no police department or town court; the Sheriff patrols under contract and charges go to District Court (Town Hall (205) 438-6219)
Parts of Birmingham, Leeds, Vestavia Hills and Childersburg also sit in Shelby County, and those cities use their own courts. The Public Defender's Office handles state court, while each city sets up its own appointed lawyers, so ask the municipal judge. A city-warrant bond goes through that city's clerk.
2. Shelby misdemeanors: DUI, mischief, petty theft, harassing messages
Shelby misdemeanor arrestees at the Shelby County Jail or a city station may post the scheduled bail by paying cash, using an Alabama bondsman or pledging Shelby property, and some sign out on recognizance. Under Rule 4.3, a person still jailed must reach a judge or magistrate within 72 hours.
The usual path
- First appearance or arraignment in District Court (Columbiana) or the city's municipal court, where you enter a plea and can ask for appointed counsel.
- Negotiation settings, where first offenders may be offered court referral, deferred prosecution or DUI school.
- A plea or a bench trial, with a right to appeal to Circuit Court for a jury.
Penalties in Shelby County misdemeanor cases
- Class A (fourth-degree theft under $500, second-degree marijuana possession): up to 12 months and up to $6,000.
- Class B: up to 6 months and $3,000; Class C: up to 3 months and $500; violations: up to 30 days.
- First DUI: up to 12 months, a fine of $600 to $2,100 and a driver's license suspension in Shelby; a fourth Shelby DUI in ten years is charged as a Class C felony in Columbiana's Circuit Court.
The Shelby County Public Defender's Office represents qualifying defendants on state misdemeanors in District Court; bring proof of income to the first setting.
3. Shelby felonies: drugs, burglary, card fraud, theft
Shelby felony arrestees stay at the Shelby County Jail until bond is posted or lowered. At the first appearance the judge confirms the charge, reviews release terms and screens the person for the Public Defender's Office.
How a Shelby County felony moves
- A District Court preliminary hearing on request, testing probable cause.
- Presentation to the Shelby County grand jury; an indictment transfers the case to one of four circuit judges. A Shelby defendant may give up the grand jury step to settle the case faster.
- Circuit Court arraignment, discovery and motions, then a plea or a jury trial.
Ranges a Shelby County circuit judge works within
- Class B: 2 to 20 years, fine up to $30,000 (first-degree theft of $2,500 or more).
- Class C: 366 days to 10 years, up to $15,000 (second-degree theft, third-degree burglary).
- Class D: 366 days to 5 years, up to $7,500 (most drug possession, third-degree theft of $500 to $1,499).
Alabama's sentencing standards point many Shelby Class C and D cases without violence toward probation, community corrections or split time, and Shelby prosecutors use the Habitual Felony Offender Act against repeat offenders. The 18th Circuit runs a drug court staffed by the public defender, and a defendant under 21 on the offense date can request youthful offender treatment, which keeps the record confidential and limits the sentence to 3 years.
4. Shelby violent felonies: robbery, attempted murder, domestic violence, murder
A violent charge in Shelby County means a longer stay at the Shelby County Jail. Through Aniah's Law, the 18th Circuit District Attorney can ask for a hearing where a Columbiana judge may deny bail in murder, kidnapping in the first degree, first-degree robbery and similar listed cases, and Amendment 1, approved by voters on May 19, 2026, widened the list so it now covers attempted murder, plus shots fired at a Shelby house or car with someone in it. If release is allowed, the judge can add a high amount, GPS and no-contact terms.
Sentencing exposure
- Class A, such as murder or first-degree assault or robbery: 10 to 99 years or life and fines up to $60,000, with added minimums when a firearm or deadly weapon is used.
- Capital murder: the death penalty, or Shelby life imprisonment with no parole.
The Public Defender's Office takes many serious cases, capital murder among them. Jail calls are recorded, so keep the facts of the case off the phone.
5. Shelby youths under 18
Shelby County runs its own secure youth facility, the Shelby County Regional Juvenile Detention Center, 222 McDow Road, Columbiana, (205) 669-3990. A juvenile probation intake officer decides whether a child goes home to a parent, gets an informal adjustment, or is detained and charged by petition. Children are not released on adult bail, and a detained child is entitled to a detention hearing within 72 hours under Ala. Code §12-15-207.
Possible results
- Informal adjustment or diversion, leaving no delinquency finding.
- Probation supervised by Shelby County juvenile probation officers.
- DYS commitment when a Shelby County youth's offense is serious or keeps recurring.
Shelby teens tried as adults
Ala. Code §12-15-204 moves Shelby 16- and 17-year-olds directly to adult court for capital offenses, Class A felonies, felonies involving a deadly weapon or dangerous instrument, felonies causing death or serious physical injury, and drug trafficking; those teens may be moved to the Shelby County Jail. For youths 14 and older, prosecutors can request a transfer hearing under §12-15-203. A child who cannot afford a lawyer gets one appointed, often from the Public Defender's Office.
6. Shelby federal charges in Birmingham
Under 28 U.S.C. §81, Shelby County is in the Southern Division of the U.S. District Court for the Northern District of Alabama, which sits at the federal courthouse at 1729 5th Avenue North in Birmingham; the clerk answers at (205) 278-1700. Shelby arrests can become federal cases for things like guns held by felons, drug dealing, bank holdups, child exploitation and fraud.
How a Shelby federal case moves
A U.S. magistrate judge handles the first appearance and, at a Bail Reform Act detention hearing, either holds the person without bail or sets release conditions. Sentences are figured under the U.S. Sentencing Guidelines, and time is spent in the Bureau of Prisons with no federal parole. If a Shelby defendant cannot afford a lawyer, the court names a federal defender or CJA panel attorney. The Shelby County Jail holds federal detainees for the U.S. Marshals, who answer at (205) 829-6611, so a federal defendant may appear on its roster. After sentencing, search the Federal Bureau of Prisons inmate locator.
