Graham County bail and bond: what happens after a Safford arrest

Adults arrested anywhere in Graham County are booked at the Graham County Detention Facility, 600 West Graham Canal Road, Safford. The sheriff is Preston "P.J." Allred. The detention desk is open every hour of every day at 928-428-2455. Think of the process in two parts. The jail knows the charge and the amount. The Clerk of the Superior Court, also in Safford, keeps the case papers and takes court payments. To see whether someone is inside, use Graham County Inmate Search, then call the desk to be sure.

Is my relative booked at the Safford jail?

Search the roster first through Graham County Inmate Search. Then phone the 24-hour detention desk at 928-428-2455. New bookings may lag online, and someone held by another agency might not be on the county list. Keep the legal name and birthday nearby. Another main number for the facility, 928-792-5214, appears in a state jail directory.

When does a Graham County judge first see my relative?

Under Arizona court rule 4.1, the jail must bring an arrested person to a judge fast, within 24 hours. If that clock runs out, the person has to be let go. The charge is read there and release rules get set. Ask the Safford Justice Court at 928-428-1210 when its next hearing is.

Back to questions ↑

Which judge or court will handle the case?

Misdemeanors start in a justice or city court. Safford Justice Court, 928-428-1210, and Pima Justice Court, 928-485-2771, cover county areas. Safford City Court and Thatcher Municipal Court share a line, 928-432-4090. Pima Magistrate Court is 928-348-3178. Felonies move to Graham County Superior Court at 800 West Main Street, Safford, 928-428-3100.

What goes into a Safford bail amount?

A.R.S. 13-3967 spells out what counts: the charge, how strong the proof is, prior arrests, family and work in the area, years living locally, and any history of skipping court. Rules like no travel or no contact can be added too. Arizona Rule 7.3 tells the court to use the least strict method that works, and not to rely on a chart of amounts for each crime.

Back to questions ↑

Is anyone held with no bail?

A small group. The Arizona Constitution (Article 2, Section 22) and A.R.S. 13-3961 allow a Safford judge to refuse bail on capital offenses, sexual assault and some child sex crimes with strong proof. For other felonies the state must request a hearing and prove danger by clear and convincing evidence. Probation or out-of-county holds are their own matter, so check with the desk at 928-428-2455 whether one is listed.

Back to questions ↑

Where do I take bond money in Safford?

Call 928-428-2455 first and ask whether the bond is paid at the facility or at the clerk's counter, 800 West Main Street. The detention desk runs around the clock. The clerk's counter keeps weekday hours of 8:00 a.m. to 5:00 p.m. Bring photo ID and the booking number. Leave with a receipt that names the case.

Back to questions ↑

Does the Safford window take cards?

Phone ahead to find out. Cash and a cashier's check are the usual safe picks, and personal checks are risky. The county has an online court payment page, but it is not clear that it covers bail. Check with the clerk at 928-428-3100 before using a card, and ask about fees.

Back to questions ↑

Is a Safford bondsman worth it?

Just when the family can't cover the full amount. Graham County's clerk's resource brochure lists two bail agents, and the county says it does not vouch for their service. Use a state-licensed agent only, and have the price, any pledged property and what a missed date costs written out. If the person is later returned to the sheriff under A.R.S. 13-3974, the agent can be released from the bond.

Back to questions ↑

Can we pledge our home for a Graham County bond?

A judge decides whether it is enough. Ask the clerk at 928-428-3100 whether land outside Graham County is accepted, how the court counts what the owner actually owns after loans, and what papers to file. Every person on the deed should expect to sign.

Back to questions ↑

Can a high bond be lowered?

It can happen, though only by court order. Rule 7.4 allows a second look when facts change or the family simply can't raise the sum. On a misdemeanor, the answer is due 10 days after that first hearing. A lawyer can file the request. Deputies and booking staff cannot change it.

Back to questions ↑

Who will defend my relative if we cannot pay?

Tell the Graham County judge at the opening hearing if counsel is unaffordable; the court decides who qualifies. The county board approves yearly contracts with private lawyers for adult and juvenile appointments. To learn who is assigned to your case, call the Clerk of the Superior Court at 928-428-3100. The clerk's brochure also lists local private criminal lawyers in Safford.

The arrest happened on the San Carlos Apache Reservation. Who holds my relative?

Part of the reservation lies in Graham County. On the reservation, tribal police make arrests and tribal court may keep the case. Call the San Carlos Apache Police Department, 99 Medicine Way, Peridot, at 928-475-1700. Ask whether the charge is tribal, state, or federal, and who is holding the person.

Where is a detained teenager kept in Graham County?

Safford has no juvenile jail. Under a contract, detained kids go to Pinal County's youth center in Florence. Juvenile court is part of the Superior Court in Safford, 928-428-3100. That office knows the child's location and hearing date.

Back to questions ↑

Will money on an inmate account free my relative?

A deposit is not bail. Money sent for phone time or commissary stays in the inmate account. It is not bail. Bond money goes to the court or the jail's payment desk, so ask 928-428-2455 which one applies. Requests for bail by gift card or phone app are scams.

Back to questions ↑

My relative missed court. What now?

Safford judges usually issue a warrant, and the bond may later be kept. Under Rule 7.6, a hearing must come within 120 days of the warrant before the money is kept. Ring the clerk right away at 928-428-3100. The court also notifies the surety.

Back to questions ↑

Is cash bail refunded?

Posted cash is paid back after the court frees the bond, unless you agreed it could pay fines or costs. Keep the receipt showing the case number. An agent's fee is different money; get its refund terms in writing.

The case against my relative is federal. Does the Safford jail take bond for it?

Safford's jail only takes bond for Graham County charges. A federal case, such as one from the San Carlos Apache Reservation or a federal agency, is filed with the U.S. District Court for the District of Arizona in Tucson:

  • A magistrate judge holds the first hearing at Tucson federal courthouse, 405 West Congress Street, Tucson, AZ 85701 (clerk 520-205-4200).
  • A federal officer interviews the defendant and checks the record.
  • Release terms are set, or the judge schedules a detention hearing.
  • Federal court handles all bond paperwork.

The Marshals in Tucson decide where federal prisoners stay: U.S. Marshals Service, 405 West Congress Street, Suite 2300, Tucson, 520-879-6900.

How does an ICE detainer affect someone being released from the Safford jail?

The county bond still settles the Graham County case. Separately, ICE can ask the jail, under 8 CFR 287.7, to keep the person as many as 48 hours longer, weekends and holidays included. Under A.R.S. 11-1051 a county can't restrict immigration enforcement, but no law here requires the hold, and Graham County has no public 287(g) agreement. Ask the jail desk before paying.

The Graham County court dates remain, even if ICE takes the person. Immigration cases go to the ICE office in Tucson (part of the Phoenix Field Office), 6431 South Country Club Road, Tucson, 520-295-4100, and people are commonly sent to:

  • Eloy Detention Center: 1705 East Hanna Road, Eloy, AZ 85131 · 520-464-3000
  • Florence Service Processing Center: 3250 North Pinal Parkway, Florence, AZ 85132 · 520-868-5862
  • Central Arizona Florence Correctional Center: Florence, AZ · 520-868-9095
