The Madison County Detention Center is licensed for 148 inmates, but it is often forced to make room for many more, especially on weekends. Typical turnover at city and county jails is at least 40% of the inmate population each month, another 30% every 90 days, and another 20% every six months, with approximately 8-9% staying six to twelve months. Inmates held longer than twelve months usually face serious charges such as rape or murder. Because it takes longer to prepare those cases for trial, offenders arrested in Madison County remain in one of the Madison County facilities much longer.
Under the Arkansas Constitution, everyone charged with a crime is entitled to bail before trial, except for capital offenses when the proof is evident or the presumption is great. For any other charge, judges in Madison County can release a defendant on their own recognizance, set conditions of release, or set a bail amount.

Voters approved a sales tax to build and run a new 148-bed jail next to the sheriff’s office, but its opening was delayed more than once. The new Detention Center passed its state inspection on July 14, 2026 and subsequently moved its inmates to the facility.
