The Madison County Detention Center is licensed for 148 inmates at any one time, but it often ends up making room for many more, particularly on weekends. At most city and county jails in Arkansas, at least 40% of the inmate population turns over monthly, another 30% every 90 days, and another 20% every six months, while roughly 8-9% remain incarcerated between six and twelve months. Stays beyond a year usually involve serious charges like rape or murder. Preparing those cases for trial takes time, so offenders arrested in Madison County remain in custody at one of the Madison County facilities much longer.
The Arkansas Constitution guarantees bail before conviction for all offenses except capital crimes where the proof is evident or the presumption is great. For years the county had only a small 24-hour holding facility, so people arrested here who weren’t released quickly were sent to jails in other Arkansas counties under contract. Voters approved a sales tax to build and run a new 148-bed jail next to the sheriff’s office, but its opening was delayed more than once. The new Detention Center passed its state inspection on July 14, 2026 and subsequently moved its inmates to the facility.

Everyone arrested is entitled to see a judge without unnecessary delay, generally within 48 hours (Arkansas Rule of Criminal Procedure 8.1). Arkansas guarantees bail before conviction except in capital cases where the proof is evident or the presumption great.
