Back to questions ↑10. Federal arrest: where the case goes
It often starts after groups such as the ATF, the U.S. Marshals Service or the FBI make an arrest. U.S. charges from San Rafael go to the Northern District of California: 450 Golden Gate Avenue, San Francisco, CA 94102. Clerk staff there answer at 415-522-2000. Plan on a first hearing before a magistrate judge the next business day the court is open. There will be an interview with pretrial services before court. In contrast to the county court, the federal court doesn't pick a number from a list. A hearing on custody guided by the 1984 Bail Reform Act decides what conditions apply.
Try the local inmate list; there the hold can be listed. Meanwhile, the Marshals Service can house federal prisoners in local jails under contract. This district's Marshals staff in San Francisco knows where a federal prisoner is held: 415-436-7677, 450 Golden Gate Avenue, 20th Floor, San Francisco, CA 94102. After a prison term, they move to a BOP prison. Follow the inmate with the federal inmate locator by name.
Back to questions ↑11. How can families handle an ICE hold?
- Right after arrest, their prints go to Homeland Security. When ICE thinks your loved one could be deportable, it can file an I-247A detainer.
- A paid bail doesn't clear an ICE hold.
- Under a detainer, ICE asks San Rafael jailers to hold the person for immigration officers up to 48 hours after they would otherwise be released (8 CFR 287.7(d)). San Rafael's jail is guided by California's Values Act (SB 54), which keeps release on time and reserves ICE notifications and transfers for a signed judicial warrant or a violent or serious conviction that qualifies. After the 48 hours end, the detainer runs out.
- Immigration officers usually pick them up at the San Rafael jail while held. If nobody comes, staff should free them.
- ICE manages this county's cases from its San Francisco office, at 630 Sansome Street, Room 590, San Francisco, CA 94111, phone 415-365-8800.
- Their next facility is up to ICE.
- Find a detained relative on the locator after the pickup; enter the inmate's A-number and country of birth. Missing the inmate's A-number? Type in date of birth, birth country and the inmate's full name instead.
12. Headed to the CDCR from San Rafael? How the transfer works
Prison time is overseen by California's prison agency (CDCR). Before that, the person stays in the San Rafael jail until the CDCR finds a bed. Then, they move to a reception unit where they're held processed. There, the CDCR reviews medical and mental care, any gang ties, and security level. Last comes a housing unit that matches their needs.
You can look them up by CDCR number in the CDCR's inmate locator. Our state prison guide lists prison addresses.
Back to questions ↑13. Does the Marin jail post mugshots online?
You can find a Marin name in the Marin County roster, but no mugshots come with it.
See PC 13665 for the law. It is about social media only. It applies to most nonviolent arrests. Agencies may not post those photos there. Posts must come down within 14 days. Fugitives and threats are the exceptions. Jail websites are outside this law. Most sheriffs in California skip photos anyway.
ICE photos become available only via ICE's online FOIA request, and only if ICE agrees. Unposted mugshots come from sheriff's staff; reporters may phone 415-479-2311. The public and the press can't obtain federal booking photos as a rule. There must be a clear reason. The U.S. Marshals put one out only to find a wanted fugitive, to assist an arrest or alert the community or when residents need quick protection.
