3. How is the bail amount set before he sees a judge?

The Superior Court adopts a countywide schedule under Penal Code 1269b(c) for people arrested without a warrant. The current one is marked "Updated November 2025." 4. What are some real Sacramento County bail amounts?

From the November 2025 schedule: misdemeanor drunk driving with no priors, $1,000; with a prior, $5,000; misdemeanor battery, $5,000; battery causing serious bodily injury, $50,000; felony corporal injury to a partner, $50,000; second-degree burglary over $950, $10,000; second-degree robbery, $50,000; robbery in a home, $100,000; assault with a deadly weapon, $50,000; grand theft over $950, $10,000.

5. Can a judge lower bail after the first appearance?

Yes. The schedule itself says that after arraignment the court makes an individual decision under the 2021 California Supreme Court case In re Humphrey. His attorney does best with job records, a lease and family letters in hand. Judges also weigh safety and the charge under Penal Code 1275.

Bail goes through the jail. Call the Main Jail at 916-874-6752 to learn where to pay and what forms the desk takes, because the Sheriff's money page does not cover bail. That page says the Main Jail cashier office is not open to the public. A lobby kiosk exists, but the Sheriff describes it as a way to put money on an inmate account, not to buy release.

Back to questions ↑

7. How is money for an inmate account different from bail?

Account money pays for store items and calls. Pay it at the lobby kiosk using cash or a debit or credit card, call it in at 866-232-1899, or mail a money order or cashier's check addressed to the Elk Grove facility. Fees apply. Personal checks are refused. These deposits do not free anyone. The Sheriff says there are no money releases on weekends or holidays.
