How does bail work in El Paso County?

  • The amount for an arrest in Colorado Springs is set by a judge, not by jail staff.
  • Prompt hearing: in most cases, the court decides bond no later than 48 hours after that person is booked into jail.
  • Signature bond: your loved one signs a pledge to show up in El Paso court.
  • Full payment: someone posts the entire amount at the lockup or court.
  • Surety: the family pays a premium so the agent covers the rest, and the fee is not refunded. By law the most is 15% or $50, if that is more.
  • Property in the state can be pledged only if equity covers 1.5 times the bond.
  • Release rules: the court can order check-ins or no contact with a victim or a curfew.
  • Other cases: a warrant from another case can keep that person inside after bond is paid.
  • Missed dates: skipping a Colorado Springs hearing date often brings a warrant, and the bond might be forfeited.
  • Ask first: call 719-390-2000 to ask about the posted bond.

What happens after a federal arrest in El Paso County?

A federal charge out of El Paso County does not go through the state courts. Court dates take place inside Colorado Springs' federal court building, 212 North Wahsatch Avenue, Suite 300, Colorado Springs, CO 80903, and the clerk's office answers at 719-471-3387. Shortly after arrest, the charged person faces a U.S. magistrate judge at a first appearance.

Federal cases don't use a bail grid. What happens instead: a federal judge holds a detention hearing; it settles jail or release before trial, and the rules. Before trial, lots of federal detainees are kept in a jail close by that houses individuals for the Marshals Service. For their location, call the Marshals at 719-633-2037. If there is prison time, the Bureau of Prisons, or BOP, becomes the custodian; the BOP inmate locator names the place.

What if ICE puts a El Paso County inmate on hold?

1. At booking, fingerprint scans go to national databases that ICE checks.

2. If ICE wants the defendant, it lodges an ICE hold on Form I-247A to jail staff.

3. The I-247A asks for 48 added hours at most after the usual release time. That time counts nonstop, including holidays and weekends.

4. State law, C.R.S. 24-76.6-102, says county jails can't hold anyone longer only because ICE asked. As a result, El Paso County lets the defendant go when the local case allows unless a court order exists.

5. ICE officers may arrive as your loved one leaves and pick the defendant up. If they do not show up, the detained person simply leaves.

Search for someone ICE holds with the online locator. Type in their A-number and birth country.
