Does this jail honor ICE holds?
- ICE uses Form I-247A to ask a jail to keep a person up to 48 hours past release.
- Senate Enrolled Act 76 (July 1, 2026) tells Indiana jails to comply with every detainer request. This jail is the one exception for now. On June 30, 2026, a special judge in the Monroe Circuit Court (case 53C06-2407-PL-001733) issued a preliminary injunction. It blocks the state from enforcing that duty, IC 5-2-18.2-9(a)(3), against this sheriff's office only. It is not a final ruling.
- On August 28, 2026, the Indiana Court of Appeals (case 26A-PL-1737) refused to pause the order while the state appeals. The sheriff's written policy says no one is kept past release only because of an administrative ICE detainer without a criminal warrant signed by a judge.
- The rest of the law still applies here: the judge is told about a detainer, and staff may not block ICE. ICE can still take a person into custody at the jail before release. Every other Indiana jail must still honor detainers.
- A hearing on a final ruling was set for October 27, 2026, so this may change. Follow the case on MyCase.
- After ICE custody, search the ICE Online Detainee Locator System.
