The sheriff's office runs countywide dispatch from the same building, so 563-568-4521 reaches someone at any hour.
1. How do I confirm someone is in the Waukon jail?
No roster is published. Search VINELink or call VINE at 888-742-8463, then double-check by phoning 563-568-4521. If the person still does not show up after a few hours, they may already be out or may be at a hospital. Our inmate search page has more options.
↑ Back to the question list2. How is the first bond amount set?
Outside court hours, the statewide uniform bond schedule supplies it. Simple misdemeanors carry $300, serious ones $1,000 and aggravated ones $2,000. For felonies the figure is $5,000 for class D, $10,000 for class C and $25,000 for class B. A First Judicial District magistrate can change the amount at the first appearance.
↑ Back to the question list3. Which cases have to wait for a magistrate?
No preset figure exists for a forcible felony or a domestic assault, nor for disobeying a protective order, stalking, sexual abuse at the first, second or third level, producing or selling meth or keeping it for sale, intimidating anyone with a dangerous weapon, or an armed felon. Anyone booked on those waits on Highway 9 for a magistrate to decide bail.
↑ Back to the question list4. What payment types are possible?
- Cash: the full bond, held until the case closes.
- Surety: a licensed insurance company's agent posts it, and the premium is not refunded.
- Property: an Iowa real estate bond approved by the court.
Before you go, call 563-568-4521 to ask how the jail takes bond at that time of day. Ignore anyone who contacts you offering a release for a fee.
↑ Back to the question list5. What is new in Iowa bail law for 2026?
Since July 1, 2026, under Senate File 2399, a person can be released on a signature alone only when the charge sits in the bottom two misdemeanor grades and has nothing to do with violence or drugs. Bail set below the schedule must come with a written reason, and the Judicial Council has until July 1, 2027 to adjust the amounts for inflation.
↑ Back to the question list6. Where is the clerk's office?
The Clerk of District Court is in the Allamakee County Courthouse, 110 Allamakee Street, Waukon, IA 52172. Call 563-568-6351 to confirm hours before going, or email countyclerk.allamakee@iowacourts.gov.
↑ Back to the question list7. Is there a penalty for skipping court?
Usually the judge signs a warrant and starts the forfeiture process, which under Iowa Code 811.6 includes notice and a 30-day wait. Prosecutors can file a new count for the no-show too. How serious it is tracks the underlying case: felony matters bring a class D felony, everything else a serious misdemeanor.
↑ Back to the question list8. When will I get cash bail back?
At the end of a case with perfect attendance, the clerk mails the cash back to whoever paid it. Unpaid fines, costs or restitution may be kept back by order of the judge. Call 563-568-6351 with timing questions, and see our money guide for funding an inmate's account.
↑ Back to the question list9. What if there is a federal case or ICE hold?
Federal charges from here are filed in the Northern District of Iowa's Eastern Division, which holds court in Dubuque and Waterloo; the clerk's office is at 111 7th Avenue SE, Cedar Rapids, IA 52401, 319-286-2300. Iowa Code chapter 27A requires the jail to honor ICE detainers, so bond on the state charge may result in a transfer. Track the person on the ICE locator.
↑ Back to the question list10. Can a parent post bail for a child?
Not in the usual way. Waukon-area youths who need secure custody are taken to North Iowa Juvenile Detention Services, 1440 West Dunkerton Road, Waterloo, IA 50703, 319-291-2455, and Iowa law gives the juvenile court 1 working day to hold a hearing on whether the child stays.

Bail for someone in the Waukon jail
Iowa does not license individual bail bondsmen. In Allamakee County, bail is posted as cash, as a property bond, or through an insurance company's surety bond.
Since July 1, 2026, Senate File 2399 has required the full cash amount instead of a ten percent deposit, unless the release order says otherwise.
A First District magistrate fixes the Waukon figure, or the bond schedule does before the first appearance, and families usually cover it with bills, a money order or a bank draft rather than a personal check. A release shows on Iowa VINE as soon as the jail updates its record.

Frequently Asked Questions about Bail and Bonds in Allamakee County
Understanding Bail for a Waukon Jail Arrest
When someone is booked into the Allamakee County Jail at 877 Highway 9, the first thing families ask is how to get them out. In Iowa, bail can mean release on conditions, a bond backed by money or property, or both, and it plays out in roughly these stages.
Schedule bond at the jail. The Iowa Judicial Council keeps a statewide bond schedule with one figure per class of crime. Section 804.21 of the Iowa Code lets a person pay that figure and be released ahead of the first hearing. A handful of offenses, among them forcible felonies and some meth crimes, are left off that shortcut.
The Waukon hearing. Without unnecessary delay, a magistrate of Iowa's First Judicial District sees anyone still in custody. The magistrate sets release terms and has to tell the defendant that a review of them can be requested.
The magistrate's choices. The factors in section 811.2 include how serious the charge is, family and job ties, finances, mental condition, length of residence and past failures to appear. Since this past July, recognizance release has been limited to nonviolent, drug-free simple and serious misdemeanor cases, and a below-schedule bail needs written reasons (Senate File 2399). Supervision, a requirement to be back in custody after set hours, or no-contact orders can be added on top of a bond.
Four ways bail can be met.
- Cash for the whole amount, deposited instead of a bond.
- A deposit with the clerk, sized by the court and made in cash or another qualifying security, standing behind an appearance bond.
- Backing from an insurer authorized in Iowa, as section 811.3 permits; the insurer's fee is a cost, not a deposit.
- Iowa real estate pledged by resident owners who justify its value by sworn affidavit, with the undertaking docketed as a lien on the property under section 811.4.
Paying the bail. The Allamakee County Clerk of District Court on Allamakee Street accepts bond during business hours. After the courthouse closes, Highway 9 jailers typically take a bond off the schedule and send it on to the clerk.
Release from the jail. After bail is in place and the paperwork reaches Highway 9, staff complete the release. Read the written release order closely, since it states each condition and the consequences of violating it.
Recovering a deposit. Once the required appearances have been made, the deposit is refunded to whoever paid it, and a surety's obligation ends at dismissal, acquittal, conviction or a deferred judgment (Iowa Code 811.8 and 811.10). The 110 Allamakee Street office returns a deposit by check after the case permits, though money the defendant posted personally may be applied first to fines or costs. Any fee paid to an insurer for a surety bond stays with the insurer.
Missed court dates. Skipping court puts the bond at risk of forfeiture under section 811.6 and is a separate offense; on a misdemeanor release it's a serious misdemeanor (section 811.2).

Cash bond in Allamakee County: who collects it?
Take it to the district court clerk at 110 Allamakee Street, Waukon, IA 52172. Weekday business hours apply at that counter, where bills, money orders or a cashier's draft are the usual tender.
My relative was sentenced to jail time. Does bail still apply?
Bail covers the time before a case is decided, plus some appeals, so a jail sentence works differently. A person ordered to serve time in Allamakee County phones the jail at 563-568-4521 to schedule an intake date, and the sheriff's jail page explains the room-and-board charge and the work-release application.
Are any charges held without bail?
Very few. Code section 811.1 removes the right to bail for a handful of situations, including killing a police officer and some people already found guilty of serious felonies but not yet sentenced.
How do I find an appointed lawyer in Allamakee County?
The State Public Defender covers Allamakee County only in part. The remainder of Waukon's appointed defense goes to lawyers holding court contracts.
Should a bonding company be checked with the court first?
Yes. The company must be an insurer authorized in Iowa under section 515.48, which the Iowa Insurance Division's company search confirms, since Iowa licenses no bondsmen.
Conditions That Can Come With Release in Allamakee County
Getting out on bail does not end the case. Iowa Code section 811.2 lets a magistrate attach conditions, and breaking one can send the person back to the jail on Highway 9.
- Supervision: release into the custody of a person or organization that agrees to keep watch over the defendant.
- Limits on movement and contact: restrictions on travel, on where the person lives and on whom they associate with, including no-contact orders protecting an alleged victim.
- Return to custody: an order to report back to the jail after set hours.
- Drug charges: anyone released on a controlled-substance charge must complete a substance use disorder evaluation and follow its treatment advice, and methamphetamine manufacturing or delivery cases add supervision and random drug tests.
When the Department of Corrections prepares a pretrial release evaluation for the magistrate, a 2026 change requires the evaluator to verify every fact in it before handing it over. A magistrate may also change the conditions later, and under section 811.7 a person who violates one or misses court can be arrested and recommitted to the sheriff until legally discharged. Every Waukon condition is spelled out in writing on the release order the defendant signs before walking out.
Instructions on how to post Bail or Bond in Allamakee County
Bail in Allamakee County is posted in a few steps, and phoning first saves wasted trips to Waukon.
- Find out what was set. Phone the jail on Highway 9 at 563-568-4521 with the person's legal name and birthdate. Ask whether the figure comes from the uniform schedule or a magistrate's order, how much it is, and which forms of bail the order permits.
- Check for holds. Ask whether a warrant or detainer from another county or agency would keep the person behind bars after this bond is satisfied.
- Pick the place and time. The Clerk of District Court at 110 Allamakee Street (563-568-6351) receives bond money during weekday office hours, and on nights, weekends and holidays a schedule bond is typically taken at the Highway 9 jail.
- Confirm the payment. Before buying a bank check or money order, ask which kinds of payment are accepted and how the payee should be written.
- Choose the form of bail. Options are full cash, an insurance company's surety bond under a written contract you have read from start to finish, or a property bond in which Iowa residents swear to the value of Iowa land they own, wherever in the state it lies.
- Keep the paperwork. File away every receipt and the release order, and put each court date on a calendar.
When the figure is beyond the family's means, defense counsel may request a review, and a defendant still held afterward may take the request to a district court judge with jurisdiction over the case, who must set it for hearing promptly (section 811.2). For the clerk's fax and other courthouse contacts, see the First Judicial District listing for Allamakee County.
Who can post Bail or Bond for a Defendant at Allamakee County Jail?
Cash bail for an Allamakee County defendant can come from anybody, including relatives, friends, a pastor or the defendant. Whoever hands over the money should hold on to the receipt, since the refund at the end of the case is paid to the depositor shown on it. A quick call to the clerk at 563-568-6351 beforehand tells the payer which ID the office will ask to see.
A bond guaranteed by a third party works differently, and only insurers and property-owning residents qualify. Section 811.3 lets an insurance company holding Iowa authority under 515.48 sign, or a homeowner or landowner living in this state whose holdings here cover the bail and who confirms that before an official who can give oaths. With no bondsman license in Iowa, a Waukon surety bond is legitimate only when its paperwork names an insurer authorized in this state.
Young people are handled on a separate track. A child arrested in Allamakee County is normally sent through juvenile court, whose office is reached at 563-589-7831 in the same Allamakee Street building as the district clerk. The jail at 563-568-4521 can tell a parent whether their son or daughter was brought to Highway 9 at all.
