What bond amounts does the sheriff list?

The jail page posts the same figures as Iowa's uniform bond schedule: $300 for a simple misdemeanor, $1,000 serious, $2,000 aggravated, $5,000 for a class D felony, $10,000 class C and $25,000 class B. Driving while suspended is listed at $566.25. These apply until a Sixth Judicial District magistrate reviews the case.

Which charges are listed as no bond?

Benton County's list shows no bond for a class A felony and for domestic abuse or a no-contact order violation. Statewide, the schedule also leaves out other forcible felonies and stalking, sexual abuse in its first three degrees, meth made, sold or kept for sale, and intimidation with a dangerous weapon, so those people sit in Vinton until a judge sets terms.

How is a bond posted in Vinton?

  • Cash: paid in full and returned at the end if the defendant shows up every time.
  • Bonding agency: the sheriff's site links to a list of agencies; their fee stays with them.
  • Real estate: Iowa property pledged with court approval.

Call 319-472-2337, option 2, to ask what payment the jail can accept right now. Do not pay a stranger who phones claiming they can get the person out.

What did Iowa's 2026 bail law change?

Senate File 2399, in force since July 1, 2026, narrows signature-only release to the two least serious misdemeanor classes, and rules it out for drug or violent offenses. Any judge going below the bond schedule must explain why on paper. The Judicial Council has to revisit the schedule for inflation no later than July 1, 2027.

Where is the clerk of court?

The Clerk of District Court is in the Benton County Courthouse, 111 East 4th Street, Suite 4, Vinton, IA 52349. Call 319-472-2766 before you head over, or email countyclerk.benton@iowacourts.gov.

What if a Benton County defendant skips a hearing?

Expect a bench warrant and a forfeiture of the posted bond, with the notice and 30-day period set by Iowa Code 811.6. A separate failure-to-appear count can be added too: a class D felony if the missed case was a felony, a serious misdemeanor if it was not.

Is cash bail refunded in Vinton?

After the case is closed, provided the accused attended every hearing. The clerk mails the refund to the payer, though the court can apply it first to what the accused owes in fines or restitution. Call 319-472-2766 about delays. Money for a jail account is covered in our money guide.

How do federal or ICE holds affect release?

A federal case from Benton County is handled by the Northern District of Iowa in Cedar Rapids, 111 7th Avenue SE, Cedar Rapids, IA 52401, 319-286-2300, and only that court sets release on it. Under Iowa Code chapter 27A the jail follows ICE detainers, so bailing out on a state charge may just shift the person to federal immigration custody. Follow them on the ICE locator.

My child was arrested. Is there a bail amount?

No schedule figure applies to delinquency cases. If Vinton officers or deputies need a secure placement, the youth goes to the Central Iowa Juvenile Detention Center, 2317 Rick Collins Way, Eldora, IA 50627, 641-858-3852. A juvenile judge reviews the hold within 1 working day.

How do Bail Bonds work at Benton County Jail

How Bail Works for the Benton County Jail

Iowa issues no license to commercial bail bondsmen. Release money can take three forms under Iowa Code chapter 811: full cash, a bond written by an insurer authorized here, or Iowa property that resident owners put up under oath. SF 2399, effective July 1, 2026, ended the ten percent cash deposit option.

While a Vinton arrest is still at the schedule stage, the amount comes from the sheriff's posted list and the money is typically handed in at the 113 East 3rd Street jail; after filing, bail moves to the Sixth District clerk's office on East 4th Street (319-472-2766).

Is there a set bond for common charges in Benton County?

Yes. The sheriff publishes a schedule on the Benton County jail page running from simple misdemeanors up through Class B felonies, plus an entry for driving while suspended. A judge can set a different amount.

Which charges have no bond at the Vinton jail?

On the sheriff's schedule, no-bond entries cover Class A felonies plus violations of domestic abuse and no-contact orders. Those people stay in custody until a judge sets release terms.

Can I pay ten percent of the bond in Benton County?

Not anymore. Iowa's SF 2399 removed the ten percent deposit option on July 1, 2026, so cash bail means the full amount.

Can a bail bondsman post bond for someone at the Benton County Jail?

Bondsmen are not licensed anywhere in Iowa. A surety bond has to come from an insurance company approved under Iowa law, or from Iowa residents pledging their Iowa real estate.

Who decides bail once a Benton County case goes to court?

A Sixth Judicial District magistrate or judge reviews release at the first appearance and can change the amount or add conditions. Counsel may request a review; the clerk's office at 319-472-2766 has the hearing schedule.

What forms of payment does the Benton County Jail take for bond?

Vinton bail is typically paid in currency, by cashier's check or with a money order, never with a personal check. Post-filing bail belongs at the East 4th Street clerk instead of the jail counter, and the desk at 319-472-2337, option 2, says which counter fits before a trip.

After Release on Bail from the Benton County Jail

Bond posted in Vinton comes with duties that last until the Benton County case ends.

  • The bond normally covers the whole case. Iowa Code section 811.2 keeps bail in effect until the case is finished or judgment is deferred, though a judge may raise it if it proves too low.
  • Conditions can be added. The court can change release conditions at any point, so read every new order.
  • Missed court brings a warrant. Under section 811.7, a defendant who skips a hearing or breaks a condition can be arrested anywhere in Iowa and returned to the Benton County Sheriff.
  • Keep the clerk's address current. Notices come from the Clerk of District Court at 111 East 4th Street #4 in Vinton; check dates on Iowa Courts Online.
  • Surrender ends a surety's risk. Before any forfeiture, section 811.8 allows the defendant's own surrender, or surrender by the surety, which frees a cash deposit for refund or releases the surety.

A Benton County release order spells out its terms, for example a no-contact order, a ban on leaving Iowa or regular pretrial check-ins, and the defendant leaves Vinton with a copy while the court file holds the original.

Instructions on how to post Bail or Bond in Benton County

Posting Bond at the Benton County Jail, Step by Step

In Vinton, bail questions go to two places: the jail at the Law Enforcement Center, 113 East 3rd Street, Vinton, IA 52349, and the Clerk of District Court, 111 East 4th Street #4. Before going to either, phone 319-472-2337 (option 2) for the jail and 319-472-2766 for the clerk with these questions:

  • How much is the bond, and was it taken from the posted schedule or set by a judge?
  • Does the order allow cash, an insurance-company bond and a real estate bond, or only some of them?
  • Can bond be paid at the Law Enforcement Center outside courthouse hours, or does it wait for the clerk's weekday schedule?
  • Which payments are accepted there, and who is named as payee?
  • Is another county or agency holding a detainer that would outlast this bond?

Paying cash

Cash bail is the full amount, because SF 2399 ended the ten percent option on July 1, 2026. Check which payments are accepted before buying any certified funds.

Bonds through an insurer

When surety is permitted, only an insurer cleared to write bail bonds in Iowa qualifies, since Iowa issues no bondsman licenses. Ask for the company's name, read the contract and its collateral terms, and keep a copy.

Pledging property

Iowa residents may pledge Iowa real estate they own by sworn statement of its value. Owners typically bring the deed or a recorded title, a current assessed value from the Benton County Assessor and proof of any mortgage balance.

Seeking a bond reduction

Through counsel, a defendant may seek a section 811.2 review of the bond amount or the conditions. The Cedar Rapids office of the State Public Defender (319-398-3690) is appointed for indictable Benton County cases when a defendant qualifies.

Who can post Bail or Bond for a Defendant at Benton County Jail?

Anyone can post cash bail for a person in the Benton County Jail: a spouse, parent, friend or employer. Keep the receipt, because a refunded deposit goes to the name shown on it. The payer should bring a government-issued photo ID, since the receipt and any refund are issued in that person's name.

Standing as surety carries more risk than a cash deposit. Iowa Code 811.3 allows only an insurance company approved under section 515.48, or Iowa residents pledging Iowa real estate worth the full bond under oath. Any business offering a surety bond ought to say which insurer stands behind it.

Juveniles arrested in Benton County usually go through juvenile court instead of adult bail; the Juvenile Court Office at 111 East 4th Street in Vinton answers at 319-472-3957.
