2. I want to pay bail tonight. What do I do first?

Tell the corrections officers you have arrived before you pay anyone's bond. The lobby kiosk at the facility is how bond is paid after the clerk's office closes, and staff expect you to check in with them first. The desk is reached at 920-294-4059.

Bring the exact amount in bills, because the kiosk gives no change.

Back to questions ↑

3. What does the lobby kiosk accept for bail?

Cash or a debit card. It does not take credit cards, and it hands back no change.

A fee is charged on every transaction, and the fee on a debit card is 10 percent of the payment. Count the fee into your budget before you drive over.

4. Can I pay bond at the Clerk of Courts instead?

Yes, for Green Lake County cases and only while the clerk is open. The Clerk of Circuit Court is at 571 County Road A, open 8:00 a.m. to 4:30 p.m., closed on county holidays. The phone is 920-294-4145.

The clerk's office works from the same county campus as the jail. Court questions can also go to the circuit court line, 920-294-4044.

5. Is a bail bondsman available in Berlin or Green Lake?

No. Wisconsin has outlawed bail bonding for a fee. Wis. Stat. 969.12 allows only an individual who lives in Wisconsin to act as a surety, and it bars anyone from being paid for it.

That leaves two lawful paths: the court's cash bail, or release without cash on a signed promise and conditions. Hang up on any caller who asks you to wire a fee.

Back to questions ↑

6. Will I get the bail money back when the case ends?

Not automatically. The facility's rules say posted money may be applied to fines and court costs, and appearing in court does not guarantee its return. The court decides after the case concludes.

When a case is dismissed or ends in acquittal, the deposit returns to the person who paid it. After a conviction, the court can apply it to fines, court costs and restitution first.

7. When can I visit, and how do I schedule?

Visits are by appointment only. Call 920-294-4059, extension 3, Monday through Friday from 8:00 a.m. to 4:00 p.m. Weekly requests are due by 4:00 p.m. on Thursday.

Visiting days are Friday 2:00 to 10:00 p.m. and Saturday and Sunday 9:00 a.m. to 10:00 p.m. Each visit lasts 30 minutes, and there are no visits from 12:30 to 1:30 p.m. or 5:00 to 6:30 p.m.

Back to questions ↑

8. How many visits does a person get, and who can come?

The number of weekly visits depends on classification: one for maximum security, two for medium and three for minimum. Each person keeps a visitor list of up to five adults.

A child under 18 does not need to be on the list but must come with a parent or guardian who is. Cell phones are left outside.

9. How does Huber work in Green Lake County?

Huber privilege is given through electronic monitoring. The person lives at a residence and wears a GPS ankle bracelet, and some drunk-driving sentences also require alcohol monitoring.

The Judgment of Conviction states whether Huber is allowed, not the jail. The Sheriff or corrections administration reviews each application. A person waiting for trial and unable to pay bail does not qualify, and Green Lake County will not accept a Huber transfer from another county for a person with open cases.

10. How soon does a judge look at the case after an arrest?

Within a reasonable time under Wisconsin law. If no warrant was used, court decisions set 48 hours as the limit for a probable cause review.

The first appearance can be held by video, and the judge sets bail and conditions there. The circuit court at 920-294-4044 has the calendar.

Back to questions ↑

11. Which bail rules does a Wisconsin judge follow?

Bail means money only. A judge may set it only after finding that it is needed to assure the person returns to court, or, in a violent-crime case, after weighing all the circumstances.

Everything else, including no-contact orders, travel limits and weapon bans, is a condition of release. Judges often use conditions without any bail.

Back to questions ↑

12. What if the charge is a misdemeanor?

Misdemeanor bail cannot be higher than the maximum fine for the offense. A statewide misdemeanor schedule guides officers, who release many people without cash unless they lack ID, appear dangerous, have no local ties or earlier skipped court.

Felonies have no cap and no price list. The judge looks at the charge, the record, the evidence and what the person can afford.

Back to questions ↑

13. Can a judge deny bail?

In rare cases, under Wis. Stat. 969.035. The prosecutor must show the charge or prior record qualifies and that no release conditions can protect the public.

The hearing is held within 10 days with a clear-and-convincing standard, and a denial lasts at most 60 days after that hearing.

14. What about a citation from Berlin, Green Lake, Markesan or Princeton?

Those four cities use Lakeside Municipal Court for their citations, and that court answers at 920-924-2479. A municipal ordinance case is separate from a county criminal case.

Cash bail for a county charge goes through the facility or the Clerk of Circuit Court, not through the municipal court.

Back to questions ↑

15. Does a domestic abuse arrest follow special rules?

Yes. Under Wis. Stat. 968.075, officers must arrest when the legal tests are met, and the person cannot be let out until bail is posted or a judge sees the case.

Release comes with a 72-hour no-contact period. The person must sign an acknowledgment, and a refusal means no release. A knowing violation can cost up to $10,000 or nine months in jail.

16. Who is the public defender for Green Lake County?

The State Public Defender office in Fond du Lac serves Green Lake County. It is at 25 3rd Street, Fond du Lac, WI 54935, phone 920-929-3990.

Ask the judge for a lawyer at the first appearance. A person still held 72 hours afterward can ask the judge to review bail.

17. Where do I take questions about a juvenile arrest?

Juvenile cases move through their own part of circuit court, which the adult search does not show. Call the court at 920-294-4044 for the hearing date and for the place where the court has directed the youth to stay.

The Sheriff's Office, 920-294-4000, can say which agency made the arrest.
