Cocke County Jail Inmate Bail & Bonds

Most Cocke County pretrial inmates are held in Jefferson County under a contract between the two counties. The Sheriff's Office books the arrest in Newport, and the county places the person in a jail that has room. Search the name in Cocke County Inmate Search first.

Flooding from Hurricane Helene damaged the jail and its annex, and the county has not been able to reopen them. The county is working on a replacement. Until then the Sheriff's Office relies on other counties' beds. That is why a Newport arrest can end with a person in a different county's facility.

Bail is a court matter, and Cocke County courts keep the case, so payment goes through Cocke County: the court clerk, a bondsman, or a property bond. Do not hand money to any jail in another county unless the Cocke County Sheriff's Office tells you to.

The Circuit Court Clerk, 423-623-6124, and the General Sessions clerk, 423-623-8619, handle court payments in Newport. The Sheriff's Office, 423-623-6004, can tell you how a payment reaches the person's holding jail.

The whole amount. Under Tennessee Code 40-11-118, a defendant with bail set may deposit that exact sum with the court clerk, and the clerk may accept a debit card or mobile app and pass on its fee. There is no cash discount, and the money is returned at the end of the case after fines and court costs (40-11-119 and 40-11-121).

For a Tennessee resident the consumer notice in 40-11-151 puts the premium at about 10 percent. A one-time $25 initiation fee and a $12 bail tax can be added. A nonresident may pay 10 to 15 percent. Ask for a receipt for every charge, and for a written receipt describing any collateral and how to get it back.

A bondsman cannot surrender the defendant arbitrarily; good cause is required.

A bondsman needs a license from the Board of Professional Bondsmen (40-11-321) and approval from the courts of the judicial district. Cocke County is in the Fourth Judicial District, along with Grainger, Jefferson and Sevier counties. Ask to see both, then confirm with the Circuit Court Clerk. A bondsman who is not approved here cannot write your bond.

Tennessee permits real estate in the state to back a bond. A written bond signed by at least two sufficient sureties who are not bondsmen or lawyers is another option. The court has to check title, so this takes days rather than hours. Call the Circuit Court Clerk before you collect the deed.

The judge looks at the factors in 40-11-118(b): how long the person has lived here, work and finances, family ties, character, record, past court appearances, the nature of the charge and any danger to others. A responsible community member may vouch for the defendant, but not for more than two people at a time.

The court must start there. Section 40-11-115(b) calls for considering release on the person's own promise or an unsecured bond first, then the least onerous conditions under 40-11-116. Money bail is allowed only if conditions will not reasonably assure the person returns (40-11-117). Ask for this at the first hearing.

A capital charge cannot be bailed under Article I, section 15 of the Tennessee Constitution. A hold from another county or agency keeps a person in jail even after bail is paid. In stalking and some domestic cases, no release is allowed within 12 hours of arrest unless the official finds no threat to the victim; the hold can run 24 hours in an aggravated assault with strangulation or a weapon (40-11-150).

The judge appoints one. The public defender for the Fourth Judicial District answers at 865-397-0108. At the first appearance a magistrate must explain the right to counsel and the right to stay silent (Tenn. R. Crim. P. 5). A felony preliminary hearing is held within 14 days for someone in custody and within 30 days for someone released.

Ask the Sheriff's Office which jail he is in, since the rules belong to that jail. For Cocke County's own detention center, commissary funds go through Access Corrections and phone funds through Inmatesales.com, and outside items cannot be sent in. Neither payment counts as bail.

The adult search leaves out juveniles. Call the Sheriff's Office at 423-623-6004 and ask where the youth is and which court officer is handling the case. Have the child's full name and birth date ready.

The court may forfeit the bond (40-11-139 and 40-11-201) and order his arrest. A bondsman can bring him in under 40-11-132. A surety is not responsible for fines, costs or restitution unless the bond says so, with the surety's consent (40-11-118(c)). Call the clerk the same day.

The Sheriff's Office, the clerks and licensed bondsmen do not ask for gift cards, crypto or a payment-app transfer to a stranger. Hang up on anyone who does, and call 423-623-6004 to check.
