The Choctaw County Jail is licensed to house 52 inmates, but it is often forced to hold many more, particularly on weekends. Across most city and county jails, at least 40% of inmates turn over within a month, another 30% within 90 days, and another 20% within six months, and about 8-9% stay six to twelve months. When an inmate is held longer than twelve months, it’s usually because they face a serious charge like rape or murder. Those cases take time to prepare for trial, so offenders arrested in Choctaw County remain in the Choctaw County facility much longer.
Each year, approximately 1,640 offenders are arrested and detained by Choctaw County law enforcement agencies.
The Choctaw County Jail is a small county jail at 217 South Hamburg Avenue in Butler, run by the Choctaw County Sheriff’s Office under Sheriff Scott Lolley. It holds men and women arrested in Choctaw County on misdemeanor and felony charges. Alabama Rule of Criminal Procedure 4.3 requires that an arrested person see a judge without unnecessary delay and within 72 hours. Choctaw County cases go through the First Judicial Circuit, shared with Clarke and Washington counties.
Alabama guarantees bail to most defendants. It can be denied in capital cases when proof is evident or the presumption great. It can also be denied after a pretrial detention hearing under Aniah’s Law (2022) for murder, first-degree kidnapping, rape, sodomy, sexual torture, domestic violence, human trafficking, burglary, arson, robbery, aggravated child abuse and certain offenses against children, and terrorism. In May 2026, voters added solicitation, attempt, or conspiracy to commit murder and shooting into an occupied building or vehicle (Amendment 1, 81.6% yes). Rule 7.2 suggests $10,000–$60,000 for a Class A felony, $5,000–$30,000 for Class B, $300–$6,000 for a Class A misdemeanor, and $1,000–$7,500 for DUI, but judges may set any amount. Release can be on personal recognizance, an unsecured bond, or a secured bond. The jail takes cash, cashier’s checks, and money orders, not personal checks.
Each person gets one 30-minute visit a week, with up to two guests. Visiting hours are 9–11 a.m. and 2–4 p.m. every day, plus 6–8 p.m. Monday through Friday. Call the jail before you go to confirm times. Adults need government photo ID. Children must come with a parent and proof such as a birth certificate. Dress modestly: no shorts, tank tops, low-cut shirts, hats, or heels over an inch. No public bus serves the jail; most visitors drive. Valero at 210 W. Pushmataha Street and Exxon at 800 S. Mulberry Avenue sell gas. Hardee’s (109 E. Pushmataha St.) and McDonald’s (221 E. Pushmataha St.) are close by.
