A judge can. Under North Dakota Rule of Criminal Procedure 46 the judge begins with release on a promise to appear or an unsecured bond, and adds money or a surety only when needed to secure the person's return. State law also lets a court raise or lower bail for good cause, and a defendant who asks for a reduction gives the state's attorney notice.

An arrested person goes before a judge without unnecessary delay. The Supreme Court's Rule 63 sets the goal at 48 hours from arrest. An arrest on a Friday afternoon can mean a Monday hearing. After the hearing, a person who still cannot meet the conditions within 48 hours may ask the judge to take another look.

The court declares the bail forfeited. The clerk notifies the surety, and from that notice the surety has 90 days to pay or to ask to set the forfeiture aside. If the surety fails to pay, its license to write bonds is suspended automatically.
