The Elmore County Jail is licensed for 242 inmates, but it is often forced to make room for many more, especially on weekends. Typical turnover at city and county jails is at least 40% of the inmate population each month, another 30% every 90 days, and another 20% every six months, with approximately 8-9% staying six to twelve months. Inmates held longer than twelve months usually face serious charges such as rape or murder. Booking comes first, and then the first court appearance. Alabama Rule of Criminal Procedure 4.3 says that must happen without unnecessary delay and within 72 hours of arrest. Elmore County belongs to the Nineteenth Judicial Circuit along with Autauga and Chilton counties. Anyone picked up on an “FTA” (failure to appear) writ should know that the sheriff can’t simply approve bond. The person has to see a judge or meet whatever conditions the writ lists, such as paying fines or child support. Alabama’s Constitution guarantees bail to most defendants. Capital cases are the exception when proof is evident or the presumption great, and Aniah’s Law (2022) lets judges hold people without bail after a detention hearing on charges of murder; first-degree kidnapping, rape, sodomy, sexual torture, domestic violence, human trafficking, burglary, arson, or robbery; aggravated child abuse and certain crimes against children; and terrorism. Amendment 1, approved by 81.6% of voters in May 2026, added solicitation, attempt, or conspiracy to commit murder, and shooting into an occupied building or vehicle. Judges start from the Rule 7.2 schedule, for example $10,000–$60,000 for a Class A felony, $5,000–$30,000 for Class B, $300–$6,000 for a Class A misdemeanor, and $1,000–$7,500 for DUI, and can move up or down from there. A defendant may be released on personal recognizance, an unsecured appearance bond, or a secured bond using cash, property, or a bail bond company. Video visitation machines are in the jail, and families can also visit remotely by phone or computer through NCIC. On-site visits are free on Saturdays and Sundays from 8:00 to 10:30 a.m. and noon to 4:00 p.m., for up to two guests (a third is allowed if that person is a child under 6). Remote visits run daily from 8:00 a.m. to 9:00 p.m. and cost $5.95 for 20 minutes. No bus line reaches this stretch of Highway 231, so most visitors drive.
Wetumpka Pacecar at 8431 US-231 and Chevron at 8350 US-231 are just down the highway from the jail. Guthrie’s Chicken Fingers at 26 Line Dr and Dairy Queen at 308 S Main St are good quick stops in town.
