There are two types of immigration bonds available to illegal aliens in ICE custody. If the detainee is not considered a threat or danger to society and not a flight risk, there is a better than even chance that they can get bail. The two types of Immigration bail are:
1. A Delivery Bond – A Delivery Bond attempts to ensure that the illegal immigrant being detained shows up for all of the hearings required by law. If the detainee has a bonafide residence and strong family and community ties, the court may allow the person to remain free while they wait for their hearings.
2. Voluntary Departure Bond – A Voluntary Departure Bond is paid to ICE as a condition for a detainee’s release. The bond is then released as soon as the person can prove that they voluntarily left the United States and returned to their home country.
