What is Immigration bail?


There really isn’t immigration bail, per se, but there are Immigration Bonds. There are two types of immigration bonds available to illegal aliens in ICE custody. If the detainee is not considered a threat or danger to society and not a flight risk, there is a better than even chance that they can get bail. The two types of Immigration bail are:

  1. A Delivery Bond – A Delivery Bond attempts to ensure that the illegal immigrant being detained shows up for all of the hearings required by law. If the detainee has a bonafide residence and strong family and community ties, the court may allow the person to remain free while they wait for their hearings.
  1. Voluntary Departure Bond – A Voluntary Departure Bond is paid to ICE as a condition for a detainee’s release. The bond is then released as soon as the person can prove that they voluntarily left the United States and returned to their home country.
